RESOLUTION FOR SUMMARY VACATION OF
AN UNNAMED RIGHT OF WAY IN LOT 4 OF THE CENTENNIAL TRACT
WHEREAS, that certain right of way and public utility easement lying within the
northerly 30 feet of Lot 4 of the Centennial Tract, as filed for record on April 4, 1950 in
Book 17 of Maps at pages 38 and 39, Butte County Official Records, is no longer
necessary or required for road purposes; and
WHEREAS, the utility companies have confirmed they have no facilities within
said right of way and do not need a reservation of said right of way for future facilities;
and
WHEREAS, the County has not constructed, operated or maintained a public
highway within said right of way; and
WHEREAS, pursuant to the Streets and Highways Code Section Division 9, Part
3, Chapter 4, commencing with Section No. 8330, the Board finds that said right of way
should be summarily vacated;
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the
County of Butte, State of California, as follows:
The following-described portion of that certain right of way and public utility
easement lying within the northerly 30 feet of Lot 4 of the Centennial Tract, as filed for
record on April 4, 1950 in Book 17 of Maps at pages 38 and 39, Butte County Official
Records, said right of way is hereby summarily vacated and abandoned pursuant to
Streets and Highways Code Division 9, Part 3, Chapter 4, commencing with Section No.
8330:
BE IT FURTHER RESOLVED, that the clerk of this Board shall cause a
certified copy of this Resolution, with the seal of the Board of supervisors of the County
of Butte, State of California, to be recorded in the Office of the Recorder of the County of
Butte, State of California. And from and after the date the Resolution is recorded, the
public right of way vacated no longer constitutes a public right of way.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 9t" day
of January 2007, by the following vote:
AYES: Supervisors Connelly, Kirk, Josiassen, Yamaguchi and Chair Dolan
NOES: None
ABSENT: None
NOT VOTING: None ,
