HomeMy WebLinkAbout07-005~~ BC3:ARD ~1F SUPEt~\/=St~RS COUNTY OF BUTTE, STATE Of CALIFORNIA Resolution No. RESOLUTION AUTHORIZING RECORDING PERPETUAL CONSERVATION EASEMENT GRANT IN FAVOR OF CALIFORNIA OPEN LANDS WHEREAS, the County of Butte is a municipal corporation and is the sole owner in fee simple of certain real property located in the County of Butte, State of California; and WHEREAS, County of Butte intends to expand an existing landfill on a portion of this property; and WHEREAS, a permit, (Permit Number 200300113) was required from the U. S. Army Corps of Engineers (Corps), dated December 9, 2003, for the Neal Road Sanitary Landfill to fill waters of the United States as necessary to complete the landfill expansion; and WHEREAS, a requirement of the permit provides for the establishment of a Preserve for conservation measures and mitigation for certain impacts for this property; and WHEREAS, a PERPETUAL CONSERVATION EASEMENT GRANT (Easement), establishes the Preserve; and WHEREAS, the Preserve possesses natural resources with significant ecological values that benefit endangered, threatened and other rare species; and WHEREAS, the Preserve, consisting of approximately 5.00 acres, has been identified as being potential habitat for species of native plants and wildlife which the County of Butte desires to restore and enhance pursuant to an Open Space Management Plan dated January 2006 by Gallaway Consulting, Inc.; and WHEREAS, California Open Lands is a private non-profit 501 (c) (3) corporation under the laws of the State of California, and is authorized to hold conservation easements under California Civil Code §81 S et seq.; and 07-005 WHEREAS, the County of Butte intends to convey to California Open Lands the right to inspect and monitor the management of the conservation values of the Preserve; and WHEREAS, California Open Lands agrees by accepting the Easement to honor the intentions of the County of Butte to inspect and monitor in perpetuity, the conservation values of the Preserve in accordance with the terms of the Easement and Open Space Management Plan. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors authorize the recordation of a PERPETUAL CONSERVATION EASEMENT GRANT in favor of CALIFORNIA OPEN LANDS, a private non-profit 501 (c) (3) corporation PASSED AND ADOPTED by the Butte County Board of Supervisors this 9th day of January 2007, by the following vote: AYES: Supervisors NOES: None ABSENT: None NOT VOTING: None Connelly, Kirk, Josiassen, Yamaguchi and Chair Dolan ,' Chair;.
