HomeMy WebLinkAbout07-036RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ADOPTING EXHIBIT IDENTIFYING APPLICABILITY OF AGRICULTURAL BUFFER SETBACK ORDINANCE WHEREAS, the Board of Supervisors adopted Resolution 06-168 on December 12, 2007, directing the Department of Development Services to prepare an implementing ordinance for Program 2.2 of the General Plan Agricultural Element pertaining agricultural buffers for residential development; and WHEREAS, staff presented a draft ordinance, entitled Agricultural Buffer Setback Ordinance for review by the Planning Commission on January 25, 2007; and WHEREAS, the Planning Commission made a recommendation by resolution on January 25, 2007, to the Board of Supervisors to approve the Agricultural Buffer Setback Ordinance; and WHEREAS, the Board of Supervisors held a public hearing on February 13, 2007, to consider the Planning Commission's recommendation, public testimony and a negative declaration under the California Environmental Quality relating to the Agricultural Buffer Setback Ordinance; and WHEREAS, the Agricultural Buffer Setback Ordinance contains a reference to a separate exhibit that is adopted by resolution of the Board of Supervisors illustrating the applicability of the ordinance; and WHEREAS, the Board of Supervisors approved the Agricultural Buffer Setback Ordinance (Ordinance number 3953 on February 13, 2007; and WHEREAS, the Board of Supervisors evaluated a printed version of the exhibit attached as Exhibit A to this resolution and a computer disk version of Exhibit A; and WHEREAS, the Director of Development Services shall maintain the digital version of the exhibit and this shall constitute the official version; and WHEREAS, it may be necessary for the Director of Development Services to update the map to correct mapping errors, show project specific determinations by the Planning Commission or Board of Supervisors or general plan map amendments affecting the Grazing and Open Lands or Orchard and Field Crop land use designations. NOW, THEREFORE BE IT RESOLVED, after due deliberation, study and consideration of public comment, the Planning Commission recommendation, the staff report and related materials, the County General Plan, the Board of Supervisors hereby considers Exhibit A as an illustration of the applicability of the ordinance. NOW, THEREFORE BE IT FURTHER RESOLVED, the Board of Supervisors authorizes the Director of Development Services to maintain the official version of the Exhibit A including modifications as necessary to correct for mapping errors, update for project specific determinations and general plan updates.
