A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF
BUTTE AUTHORIZING THE CHAIR OF THE BOARD OF SUPERVISORS TO
SIGN THE MASTER PROPERTY TAX AGREEMENT WITH THE PARADISE
IRRIGATION DISTRICT
WHEREAS, Section 99, Subdivision (b), Paragraph (5) of the Revenue and Taxation
Code provides as follows: In the event that a jurisdictional change would affect the
service area or service responsibility of one or more special districts, the board of
supervisors of the county or counties in which (the) districts are located shall, on behalf
of the district or districts, negotiate any exchange of property tax revenues.
WHEREAS, the Revenue and Taxation Code further provides in Section 99.01,
Subdivision (a), Paragraph (3): Notwithstanding the provisions of paragraph (5) of
subdivision (b) of Section 99, any special district affected by the jurisdictional change
may negotiate on its own behalf, if it so chooses.
WHEREAS, Section 99 further provides in Subdivision (d): With respect to adjustments
in the allocation of property taxes pursuant to this section, a county and any local
agency or agencies within the county may develop and adopt a master property tax
transfer agreement. Such agreement may be revised from time to time by the parties
subject to such agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County
of Butte as follows:
1. This Board agrees that no property tax transfer will occur as a result of any
annexation of territory to the Paradise Irrigation District.
2. The Chair of the Board of Supervisors is directed to execute the Master Property
Tax Transfer Agreement depicted in Exhibit "A".
THE FOREGOING RESOLUTION WAS PASSED AND ADOPTED at a regular
meeting of the Board of Supervisors of the County of Butte this 12th day of June, 2007
by the following vote:
AYES: Supervisors Connelly, Kirk, Josiassen, Yamaguchi, and Chair Dolan
NOES: None
ABSENT: None

EXHIBIT "A"
MASTER PROPERTY TAX TRANSFER AGREEMENT
THIS AGREEMENT is made and entered into this 12th day of June , 2007 , by and
between the County of Butte, a political subdivision of the State of California, and the Paradise
Irrigation District, an independent special district authorized by Division 11 of the Water Code
of the State of California.
WHEREAS, Section 99, Subdivision (b), Paragraph (5) of the Revenue and Taxation Code
provides as follows:
In the event that a jurisdictional change would affect the service area or service
responsibility of one or more special districts, the Board of Supervisors of the
county or counties in. which (the) districts are located shall, on behalf of the
district or districts, negotiate any exchange of property tcax revenues.
WHEREAS, the Revenue and Taxation Code further provides in Section 99.01, Subdivision (a),
Paragraph (3):
Notwithstanding the provisions of paragraph (S) of subdivision (b) of Section 99,
any special district affected by the, jurisdictional change may negotiate on its own
behalf, if it so chooses.
WHEREAS, Section 99 further provides in Subdivision (d):
With respect to adjustments in the allocation of property taxes pursuant to this
section, a county and any local agency or agencies within the county may develop
and adopt a master property tax transfer agreement. Such agreement may be
revised from time to time by the parties subject to such agreement.
NOW, THEREFORE, in consideration of the premises set forth herein, the parties hereto agree
that no property tax transfer will occur as a result of any annexation of territory to the Paradise
Irrigation District hereafter and until either party hereto notifies the other of the termination of
this agreement.
IN WITNESS WHEREOF, the parties hereto have executed this agreement on the date set forth
below.
