RESOLUTION AUTHORIZING TRANSFER OF TITLE TO THE DOWNTOWN
OROVILLE COURTHOUSE TO THE CITY OF OROVILLE
WHEREAS, on March 7, 1968, the City of Oroville deeded property to the
County of Butte, whereon the County constructed a building now commonly known
as the Downtown Oroville Courthouse;
WHEREAS, in 2002, Trial Court Facilities Act (SB 1732 - Escutia) allowed the
Administrative Office of the Courts to negotiate the transfer of court facilities from
counties to the State;
WHEREAS, as a part of the negotiation with the Administrative Office of the
Court, the County agreed to relocate the Law Library from the Butte County
Courthouse to the Carnegie Library located at 1675 Montgomery Street in Oroville;
WHEREAS, the City of Oroville has offered and the County of Butte has
accepted to lease the Carnegie Library with no lease payments for a period of fifty
years with an option to extend the lease for an additional forty years with lease
payments to be negotiated prior to execution of the option;
WHEREAS, the City of Oroville has agreed to renovate its Carnegie Library for
compliance with the Americans with Disabilities Act;
WHEREAS, the County has agreed to vacate the Downtown Oroville
Courthouse and deed the property and its improvements to the City of Oroville, and
to reimburse the City of Oroville for tenant improvements to the Carnegie Library;
NOW THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the
County of Butte, State of California, do hereby authorize the Chief Administrative
Officer to execute ali necessary documents in order to transfer title to APN 012-032-
029-000, commonly known as the Downtown Oroville Courthouse to the City of
Oroville and eliminate the defeasance clause originally recorded in Book 1509 Page
576 of Official Records of the County of Butte.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 12t"day of
June 2007 by the following vote:
AYES: Supervisors Connelly, Kirk, Josiassen, Yamaguchi, and Chair Dolan
NOES: None
ABSENT: None
NOT VOTING: None
