RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF
BUTTE, STATE OF CALIFORNIA,
AMENDING RESOLUTION 07-036
ADOPTING EXHIBIT IDENTIFYING APPLICABILITY OF
AGRICULTURAL BUFFER SETBACK ORDINANCE
WHEREAS, the Board of Supervisors approved Ordinance #3953 adding section 24-
286 -Agricultural Buffer Setback Ordinance to the Butte County Code and adopted
Resolution 07-036 at a duly noticed public hearing on February 13, 2007; and
WHEREAS, the Agricultural Buffer Setback Ordinance contains a reference to a
separate exhibit that is adopted by resolution of the Board of Supervisors illustrating the
applicability of the ordinance. This resolution was adopted on February 13, 2007 as
Resolution 07-036; and
WHEREAS, the Director of Development Services shall maintain the digital version
of the exhibit and this shall constitute the official version; and
WHEREAS, it may be necessary for the Director of Development Services to update
the map to correct mapping errors, show project specific determinations by the Planning
Commission or Board of Supervisors or general plan map amendments affecting the
Grazing and Open Lands or Orchard and Field Crop land use designations; and
WHEREAS, the Director of Development Services presented a report to the Board of
Supervisors on June 26, 2007 noting several items requiring clarification including the
applicability of the Agricultural Buffer Setback Ordinance as approved on February 13,
2007 to all areas that abut the Grazing and Open Lands (GOL) and Orchard and Field
Crop (OFC) land use designations; and
WHEREAS, a proposed amendment to the exhibit attached to Board Resolution 07-
036 was presented to the Board of Supervisors for consideration showing the
applicability to all lands abutting and within 300 feet of the Grazing and Open Lands or
Orchard and Field Crop land use designations.
NOW, THEREFORE BE IT RESOLVED, the Board of Supervisors hereby
amends Resolution 07-036 with a revised Exhibit A as attached to this resolution and
authorizes the Director of Development Services to maintain the official digital version of
the Exhibit A including modifications as necessary to correct for mapping errors, update
for project specific determinations and general plan updates.
PASSED AND ADOPTED by the Board of Supervisors, of the County of Butte, State of
California, at regular meeting of said Board, held on the 26thday of June , 2007, by
the following vote:
AYES: Supervisors Connelly, Kirk, Josiassen, Yamaguchi, and Chair Dolan
NOES: None
ABSENT: None
NOT VOTING: None
