Q~' 8t.1"~`~'~~t 5TAT6 O~F CALiFORNl~1 ~~ 3~ ~; ''"~'~"'"''`«` Resolution No. o~-isb RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE INCREASING PARK FACILITY FEES IN THE DURHAM RECREATION AND PARK DISTRICT WHEREAS, the Board of Supervisors of the County of Butte, by Ordinance Number 3081, adopted on July 27, 1993, added Article V to Chapter 16 of the Butte County Code authorizing the assessment and levying of Park Facility Fees on any owner of real property located in the unincorporated area of the Durham Recreation and Park District adding residential dwelling units to such property, in order to fund the cost of the additional park facilities which will be necessary in order to meet the recreational needs of the new residents resulting from such developments; and WHEREAS, the Board of Supervisors, by Resolution Number 93-114 adopted on July 27, 1993, established the amount of the Park Facility Fees; and WHEREAS, the Board of Supervisors, by Resolution Number 04-107 adopted June 22, 2004, increased the amount of the Park Facility Fees; and WHEREAS, the Board of Supervisors, by Ordinance Number 3932 adopted March 28, 2006, amended sections 16-45 and 16-46 of Article V of Chapter 16; and WHEREAS, the Board of Supervisors, by this Resolution, desires to: increase the amount of said Park Facility Fee in the manner provided for in said Article V of Chapter 16 of the Butte County Code; demonstrate that such fee complies with all of the factors enumerated in Section 16-44 of said Article and Chapter of the Butte County Code; and, by reason thereof, confirm that Page 1 such Park Facility Fee meets each of the "nexus" requirements set forth in Section 66001 of the California Government Code, all for the reasons set out in Section 16-41 of said Article and Chapter of the Butte County Code; and WHEREAS, the Board of Supervisors has considered this Resolution at a public hearing, notice of which was given in the manner provided for by Sections 66004, 66016, 66017(a) and 66018 of the California Government Code; and, WHEREAS, the Board of Supervisors has received and considered the Park Impact Fee Nexus Study prepared by SCI Consulting Group dated June 2007 that provides all information necessary to meet the requirements of California Government Code Section 66000 et. al. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: 1. The Board of Supervisors adopts the following Park Facility Fees on new and additional residential development for parkland acquisition and development of park and recreational facilities: a. Single-Family Residence $2.35 per square foot b. Multi-Family Residence $3.95 per square foot c. Residential Additions $2.35 per square foot 2. The Board of Supervisors finds that the Park Facility Fees adopted by this Resolution comply with the requirements of Section 16-44 of the Butte County Code, entitled "Amount of park facility fees." 3. The Board of Supervisors confirms that since the Park Facility Fees adopted by this Resolution comply with the requirements of Section 16-44 of the Butte County Code, such fees also meet each of the "nexus" requirements set forth in Section 66001 of the California Page 2 Government Code, all for the reasons set out in Section 16-41 of the Butte County Code, entitled "Findings." 4. In accordance with the provisions of Section 66017 of the California Government Code, this Resolution as well as the Park Facility Fees provided for herein, shall not become effective until the 61St day following its adoption.
