TELEVISION FRANCHISE FOR THE UNINCORPORATED AREAS
OF CHICO AND DURHAM, THE UNINCORPORATED AREAS OF PARADISE,
AND THE UNINCORPORATED AREAS OF OROVILLE, BIGGS AND GRIDLEY
WHEREAS, pursuant to Butte County Resolutions 90-150, 00-71, and 02-048, the
COUNTY has granted Comcast of Southern California, Inc., an Oregon corporation and
Comcast of Northern California II, Inc., a California corporation (both of the foregoing
corporations hereinafter collectively "COMCAST") non-exclusive franchises to construct,
operate and maintain a cable television system (the ``Franchises"); and
WHEREAS, AT&T Corp. filed requests with the COUNTY prior to COMCAST's
ownership and control of cable television franchises in the Butte County area to activate the
formal process for renewing the Franchises pursuant to the provisions of the Cable
Communications Policy Act of 1984 ("Cable Act"); and
WHEREAS, the Franchises were consolidated into a single Franchise agreement for
purposes of renewal and conditionally extended by Resolution No. 04-021 passed and adopted
February 10, 2004; and
WHEREAS, COMCAST and the COUNTY have agreed to extend informal renewal
negotiations in accordance with Section 626(h) of Title VI of the Communications Act of 1934,
as amended; and
WHEREAS, pursuant to Resolution 07-061, the County extended the term of the existing
franchise agreement to October 31, 2007 to allow for said negotiations; and
WHEREAS, the amount of time required to conclude negotiations and allow for public
review will extend beyond the current expiration date; and
WHEREAS, it is in the public interest to extend the current Franchise for an additional
period of time so that cable service to the public will not be interrupted.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: The Franchise of
COMCAST shall be extended through December 31, 2007.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 9th day of
October 2007 by the following vote:
AYES: Supervisors Connelly, Kirk, Josiassen, Yamaguchi, and Chair Dolan
NOES: None
ABSENT: None
NOT VOTING: None
