HomeMy WebLinkAbout07-163~# ~~ ~4~Ft.t~ l?F Slj~~~VISO~~ ~* ~,~ COUNTY O~ BUTTE, ST/~TE OF:CALIFQRNIA Resolution No. o7-I63 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE VACATING OF PORTION OF THE PUBLIC RIGHT OF WAY ALONG LINCOLN BOULEVARD, OROVILLE, CALIFORNIA WHEREAS, a public hearing was held before the Board of Supervisors of the County of Butte, State of California, on October 9, 2007, in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Oroville, California; and, WHEREAS, notice of the time and place of the hearing on the request for the vacation was duly and regularly given as required by law; and WHEREAS, testimony and evidence, both oral and documentary, was received by the Board. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors: 1. There is no possibility the proposed vacation of these public rights of way may have a significant effect on the environment, and it is therefore not subject to the California Environmental Quality Act; 2. The proposed vacation is in conformance with the Butte County General Plan; 3. The public rights of way in question, as hereinafter described are unnecessary for present or prospective public use. 4. That the public rights of way situated in the County of Butte, State of California, as hereinafter more particularly described, are hereby vacated pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways code (commencing with Section 8320). 5. That said public right of way so vacated is located in the unincorporated area of the County of Butte, State of California, are identified as a portion of Lincoln Boulevard and is more particularly described as follows: The westerly 10 feet as measured at right angles to the westerly line of the following described parcel. Being a portion of Lot 147 as said lot is shown on that certain map entitled, "Map of Paxton Subdivision in the southwest quarter of Section 20, T19N, R4E, M. D. B. & M, Butte County, California," which map was recorded in the office of the Recorder of the County of Butte, State of California, Apri14, 1923 in Book 8 of Maps at page 50, more particularly described as follows: BEGINNING at the northeast corner of said Lot 147; THENCE South 21 ° 19' 02" East, along the easterly line of said lot, 107.13 feet to the southeast corner of said lot; THENCE South 89° 41' S8" West, along the southerly line of said lot, 32.14 feet; THENCE North 21° 19' 02" West, 107.13 feet to the northerly line of said lot; THENCE North 89° 41' S8" East, along the northerly line of said lot, 32.14 feet to the POINT OF BEGINNING. Containing an area of 1071 square feet, more or less. Reserving therefrom a public services easement, within the herein described property, for the benefit of Pacific Gas and Electric, and their heirs or assigns, and the right at any time or from time to time to construct, operate, maintain, replace, remove, renew and enlarge lines of pipe, conduits, cable wires, poles, lines and other facilities, including access and the right to keep the property free from flammable material and wood growth, and otherwise protect the same from all hazards, in, upon, over and across the portion of Lincoln Boulevard right of way to be vacated. The above described lands are to be combined with and become a part of those lands as described in the deed to Thomas W. and Patti E. Glaum as filed for record in Butte County Official Records at Serial Number 1998-0016961, and cannot be sold separately. No additional lots or parcels are created hereby. 3. That a map showing the right of way hereby vacated is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California.
