RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
SUPPLEMENTING A DISPUTE RESOLUTION FUND
PURSUANT TO THE DISPUTE PROGRAMS
ACT OF 1986
WHEREAS, Business and Professions Code Sections 465 et seq. authorize a
Board of Supervisors to set aside up to $8.00 of the civil filing fee for alternative dispute
resolution programs; and
WHEREAS, dispute resolution programs are intended to assist parties in
resolving disputes without the necessity of formal judicial proceedings; and
WHEREAS, dispute resolution programs are intended to provide accessible
forums for the public to peaceably resolve disputes, leave relationships intact and avoid
litigation; and
WHEREAS, dispute resolution programs are intended to provide dispute
resolution services in civil matters that normally come before the Court; and
WHEREAS, the California Legislature has provided that a county may fund
dispute resolution programs by retaining a portion of the state-wide uniform filing fee for
first papers filed in civil action, which portion shall not exceed $8.00; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of
Butte County that the Board approves, pursuant to the provisions of state law, retaining
$8.00, of the state-wide uniform total civil filing fee for Limited and Unlimited Civil
actions, for the purpose of supplementing a dispute resolution program.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 23rd
day of October 2007, by the following vote:
AYES: Supervisors Connelly, Kirk, Josiassen, Yamaguchi-, and Chair Dolan
NOES: None
ABSENT: None
