HomeMy WebLinkAbout08-011~*~ 0~ ~S Up~~'~~yii ~ ©• s ~ ~~~ .~• ~* : *_ ~~y~..COT T~t~~~~~ BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA R~~s~~lufi~,11 _'~'~~. og-ozi RESOI,L1'TION OF THE BU'TTECOCINTY BOARD OF SUPIH:RVISORS ADOPTING FF,E FOR IMPLEi\IEN'I'A'CION AND ONGOING OPERATION OF A SOCIAL SECURITY TRUNCATION PROGRAM WHEREAS, the Governor of the State of California signed Assembly Bill l Ib8 which adds Article 3.5 (commencing with Section 27300) to Chapter G of Part 3 of Division 2 of Title 3 of the Government Code requiring the County Recorder to establish a social security number truncation program; and WHEREAS, this program will require, for each official record recorded between J4uluaty 1, 1980 and December 31, 2008, that the County Recorder shall create, in an electronic format, an exact copy of the record except that any social security number contained in the copied record shall be truncated; and WHEREAS, the program will require, for each official record recorded on or after January 1, 2009, that the County Recorder shall create a copy of that record in an electronic format and trrGncate any social security number contained in that record; and WHEREAS, this legislation also added subdivision (d) to Section 27361 of the Govermz~ent Code which allows the County Recorder to charge an additional fee of one dollar for recording the tirst page of every instnunent, paper, or notice required or pc;riuitted by law to be recorded as authorized by each corlnty's Board of Supervisors; such fee shall not be charged after December > 1, 2017 un]ess reauthorized by the County Board of Supervisors; and WHERF,AS, the funds generated by this fee shall be used only by the County Recorder collecting the fee for the purpose of implementing a social security number 1rL117Ciit1011 pl'Ogram plll'SLlant 10 AI"tlele 3.S ~GOn1l11CT1C111g Wlth SeCtlOn 27300) Of the GOVCI'nmCnt Code. NOW, TIIEREFORE, BE [T RESOLVED that the Butte County Board of Supervisors hereby authorizes the County Recorder to begin charging an additional one dollar rccorcfing fee effective March 1, 2008 and to deposit the fees collected for this program into a special fund to be used solely by the Col.mty Recorder for the purpose of implementing the social security truncation program. 6~: t`1' H'UI2"t'1[ER RESOL~'h:D that the Butte County Bo4tr~i of~ S~iper-visol-s rec~ucsis the County f~uditor-Controller to conduct t~~~ reviews to verify that the funds ~cnerated b_y ibis fee arc used only for the purpose of the social security truncation program within the timeframes provided under Section 27361(4)(4).
