Resolution Supporting
2007 Construction or Expansion of County Jails
Request for Proposal
N0. 08--027
Wf~7ZF.AS, the County of Butte is intent on pursuing California Department of
Corrections and Rehabilitation and Corrections Standards Authority funding for Local
Jail Construction, and
Wf~RE~S', the application process with California Department of Corrections and
Rehabilitation and Corrections Standards Authority requires financial and programmatic
commitment on the part of the County of Butte, the listed are offered for adoption via this
resolution as a requirement of this application:
The County of Butte Construction Administrator shall be Richards Hall, the
Project Financial Officer shall be Sang Kim and the Project Contact person shall be
Bryan Flicker. The Authorized appropriate County of Butte official to sign the
Agreement and submit proposed fiinding shall be the County of Butte seated Chair of the
Board of Supervisors at the time of approval.
The County of Butte will adhere to State requirements and terms of the
agreements between the County of Butte, California Department of Corrections and
Rehabilitation, Corrections Standards Authority and the State Public Works Board in the
expenditure of State fiends and County of Butte match funds.
The County of Butte will appropriate, after conditional project award but before
State/County of Butte funding agreements, the amount of match identified by the County
of Butte on the funding proposal submitted to Corrections Standards Authority; further,
the County of Butte identifies the source of the cash match as Development Impact Fees
and assures that State and cash matching funds do not supplant funds otherwise dedicated
or appropriated for construction activities.
The County of Butte assures Corrections Standards Authority and California
Department of Corrections and Rehabilitation the County of Butte will fully and safely
staff and operate the facility that is being constructed within ninety (90) days after project
completion.
The County of Butte has project site control and possession through fee simple
ownership and assures the right of access to the project for undisturbed use and will not
dispose of, modify the use of, or change the terms of the real property title, or other
interest in the site of facility subject to construction, or lease the facility for operation to
other entities, without permission and instructions from the Corrections Standards
Authority.
The County of Butte attests to the current fair market value of the site as
$115,000.
The County of Butte agrees to work with California Department of Corrections
and Rehabilitation toward achieving the goal of improving successful reintegration of
adult offenders into the communities of the County of Butte and the County of Butte has
a signed agreement to cooperate with California Department of Corrections and
Rehabilitation. The County of Butte stipulates that a reentry planning team is established
for the purpose of working collaboratively with California Department of Corrections and
Rehabilitation. The reentry site will be located between the existing jail facility and the
Court and shall be operated by the Sheriff.
The County of Butte agrees to assist the State in providing a continuum of care
for mental health and substance abuse treatment so that parolees can continue to receive
services at the conclusion of their period of parole.
NOW, THEREFORE, BE IT RE5'OLVEDthat the Butte County of Butte Board of
Supervisors does adopt this resolution in its entirety dated this 11th day of March, 2008.
PASSED AND ADOPTED by the Board of Supervisors this 11th day of March by the
following vote:
