RESOLUTION FOR SUMMARY VACATION OF
A PORTION OF RIVER ROAD
WHEREAS, a portion of River Road in the north half of Section 22, Township 22 North,
Range 1 West, has been superseded by Caltrans realignment of River Road as part of their safety
construction project 03-BUT-32-1.4/1.8, is no longer necessary or required for road purposes;
and
WI-IEREAS, Pacific Bell Telephone Company has confirmed they have facilities within
said right of way and has requested a reservation of said right of way for future facilities; and
WHERF,AS, by reserving said right of way for Pacific Bell Telephone Company, the in-
place public utility facilities will not be affected by the vacation; and
WHERF,AS, the vacation of this portion of River Road will not cut off access of any
property t~ a public highway; and
WHEREAS, pursuant to the Streets and Highways Code Section Divisio~~ 9, Part 3,
Chapter 4, commencing with Section No. 8330, the Board finds that said right of tivay should be
sum~~narily vacated;
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the
County of Butte, State of California, <~s follows:

Safety Project 03-BUT-32-1.4/1.8. Said superseded River Road lying easterly of Che centerli~~e
of Pine Creek lagoon; southerly of that portion of River Road described in the Grant [iced to the
State of California, recorded August 1~, 1957 in Book 895 of Official Records at Pages 262
through 265; and northerly of River Road as Granted to the County of Butte t~ebruary l5, 2006.
under Recorder's Serial Number 2006-0007896,
Excepting and reserving therefrom, purseant to the provisions of Section 834G of tl~ie Califo~7~ia
Streets and Highways Code and for the benefit of Pacific Bell Telephone Company (dha ATc~'T'
California), their heirs and assigns, a permanent public service easement and the right at anytime
or from time to time to construct, maintain, operate, replace, remove, renew and enlarge lines of
pipe, conduits, cable wires, poles and other convenient structures equipment for tl.e operation of
telegraph and telephone lines and other communication facilities, including access for ingress
and egress and the right to keep the property free from inflammable n;aterials and wood growth,
and otherwise protect the same Gom a]] haards, in, upon, over, under and across the portion of
the herein described River Road.
QE IT FIJR"I'1iER RESOI.VF:D, that the clerk of this Board shall cause a
certified copy oC this Resolution, with the seal of the Board of Supervisors of the County of
Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte,
State of California. And from and after the date the Resolution is recorded, the pubic right of
way vacated no longer constitutes a public right of way.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 20`x' day of May
