HomeMy WebLinkAbout08-091A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS CERTIFYING THAT IT HAS REVIEWED AND CONSIDERED A NEGATIVE DECLARATION PREPARED BY THE PALMDALE WATER DISTRICT FOR THE BUTTE COUNTY-PALMDALE WATER DISTRICT EMERGENCY TABLE A WATER TRANSFER FOR 2008 AND 2009 AND AUTHORIZING PARTICIPATION IN THE TABLE A TRANSFER THROUGH THE APPROVAL OF THE TWO ASSOCIATED AGREEMENTS WITH PALMDALE WATER DISTRICT AND THE CALIFORNIA DEPARTMENT OF WATER RESOURCES WHEREAS, the Board of Supervisors has considered entering into a water transfer with Palmdale Water District, through the approval of the two associated agreements, {i.e. enter in the identification of agreements) in accordance with the terms of the County's State Water Project (SWP) Water Supply Contract; and WHEREAS, Palmdale Water District, acting as lead agency, determined it was appropriate to prepare a Negative Declazation for the Butte County-Palmdale Water District Emergency Table-A Water Transfer for 2008 and 2009; and WHEREAS, the Board of Supervisors, as a responsible agency, consulted with Palmdale, as the lead agency, during the environmental review process; and WHEREAS, the Board of Supervisors has reviewed and considered the Negative Declaration prepared by Palmdale Water District for the water transfer in accordance with the California Environmental Quality Act; and WHEREAS, the Negative Declaration does not identify any significant impacts within the jurisdiction of the Board of Supervisors as supported by the following: No new construction or improvements by Butte County, Palmdale Water District or the California Department of Water Resources would occur with the proposed water transfer; The delivery of the Table A water from Butte County to the Palmdale Water District would occur within the operating conditions of the State Water Project as determined by current licenses, permits, regulatory constraints, interim remedial actions and all applicable Biological Opinions and would therefore have no impacts upon the environment that would require mitigation; and WHEREAS, a duly noticed public hearing on the Butte County-Palmdale Water District Table-A water transfer for 2008-2009 was held before the Board of Supervisors on June 24, 2008; and WHEREAS, the Board of Supervisors has considered the staff report and recommendation of the Butte County Department of Water and Resource Conservation and the Butte County Department of Development Services, Planning Division, and public comments. NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors takes the following actions: I. Certifies that it has reviewed and considered the Negative Declaration for the Butte County -Palmdale Water District Emergency Table-A Water Transfer for 2008 and 2009 prepared by the Palmdale Water District. II. Finds the Negative Declaration to be adequate for the purpose of entering into the Table A water transfer between Butte County and Palmdale Water District. III. Finds that there are no significant impacts within the jurisdiction of the Board of Supervisors identified in the Negative Declaration. IV. Finds that there is no need for the Board of Supervisors to modify the Table-A water transfer agreements to mitigate any potential impacts. V. Authorizes the Clerk of the Board to prepare and file a Notice of Determination. VI. Approves the Agreement Among the Department of Water Resources of the State of California, Palmdale Water District and County of Butte for the Delivery of a Portion of County of Butte's State Water Project Allocated Table A Water (SWPAO #08011) and authorizes the Chair to sign subject to review by County Counsel and the Auditor/Controller. VII. Approves the Agreement for Sale and Purchase of Water Between Palmdale Water District and County of Butte for 2008 and 2009 and authorizes the Chair to sign subject to review by County Counsel and the AuditorlController. VIII. The custodian of the record is the Butte County Department of Water and Resource Conservation.
