RESOLUTION AUTHORI7ING
REDUCTION OF LIEN ON '7850 LAVA STREET, STIRLING CITY
APN # 059-096-019
WHEREAS, the Public Health Department has a lien on 7850 Lava Street in Stirling City that dates
back to 1998 for the cost of a housing nuisance abatement; and
WHEREAS, the original lien was for X9,349.92 and, with 6% interest compounding annually, the
lien is now valued at X16,744.28; and
WHEREAS, the parcel is 37.5 ft x 75 ft and has limited potential for development due to its small
sire; and
WHEREAS, the assessed valuation of the parcel in question is $2,380: and
WHEREAS, a-i appraisal valued the parcel, based on sales comparisons. at $3,921, but estimated a
cost of X4,000 to remove and dispose of scrap and debris currently stored on the parcel, yielding a
net market value of $0; and
WHEREAS, the owner of two adjacent parcels on Lava Street has expressed a desire to purchase
the parcel in question, and is requesting a reduction of the lied to the parcel"s assessed valuation of
X2,380; and
WHEREAS, the owner of the adjacent parcels wishing to purchase the parcel in question has agreed
to merge the parcel with his parcels and remove from it all scrap and debris; and
WHEREAS, a merged, larger parcel is mare developable, more manageable, and has a higher
property value than the individual parcels uncombined and under different ownerships; and
WHEREAS, it is in the public interest to rehabilitate the property as soon as possible:. and
WHEREAS, it is in the interest of health and safety to remove the present nuisance present on the
parcel in question, and
WHF.RF,AS, it is in the financial interests of the Crnanty to increase the value of propert}~ on its tax
roll:
NOW, THEREFORE BE IT RESOLVED, that the Board of Supervisors ar~thorizes the Public
I Icalth Department to reduce the lien on the 7850 Lava Street, Stirling City, ~1PN # 0>9-096-019. tt~
the assessed valuation of $2,380 or the sale price of the parcel, whichever is the greater amount, on
the condition that an escrow agreement is established requiring:
~. 'The parcel to be cleaned of all scrap and debris within 60 days of the date of the
Resolution, with receipts provided to the Public Health Department verifying the
materials have been recycled or disposed in a lawful manner; and
B. f1PN # 059-096-019 is merged with the two adjacent parcels, t~PN #059-096-020 and
APN #059-096-028.
BE IT FURTHER RESOLVED, that the Public Health Department is authorized to rean-d a
Satisfaction of Lien, upon: (a) Receipt of the reduced lien amount, or purchase price of the parcel,
whichever is greater; and (b) Verification that the conditions established in the escrow agreement arc
met.
I'he foregoing resolution was passed by the Butte County Board of Supervisors this 9`~' day of
September, 2008.
