A RESOLUTION OF THF; BUTTE COUNTY BOARD OF SUPERVISORS
CERTIFYING THAT IT HAS REVIEWED AND CONSIDF.RF,D
AS A RESPONSIBLE AGENCY
A MITIGATED NEGATIVE DECLARATION
PREPARED BY 'THE PARADISE IRR[GATION DISTRICT FOR
THE MAGALIA RAW WATER BYPASS PROJECT
WHEREAS, the Board of Supervisors has approved Resolution OS-067
authorising the tinalization of the Butte County Integrated Water Resources Plan which
sets the initial policy direction as outlined in the Plan; and
WIIIREAS, the Board of Supervisors has approved Resolution OS-089
authorizing the submittal of a grant application under Proposition _50 for Integrated
Regional Water Management funding far identified projects, which included the Magalia
Raw Water Bypass Project; and
WHEREAS, the Board of Supervisors has approved Resolution 08-04$
authorizing the Department of Water and Resource Conservation to negotiate a grant
agreement under Proposition 50 with the Department of Water Resources which will
provide for partial funding for the Magalia Raw Water Bypass Project; and
WHEREAS, the Board of Supervisors, as a Responsible Agency, has reviewed
and considered the Mitigated Negative Declaration prepared by Paradise; Irrigation
District for the Magalia Raw Water Bypass Project (State Clearinghouse ]dumber 2007-
01-2006) in accordance with the California F,nvironmental (duality Act; and
WHERF,AS, the Mitigated Negative Declaration does not identify any significant
impacts that cannot be mitigated within the jurisdiction of the Board of Snpervis<xs; and
WHEREAS, a duly noticed public hearing on the Magalia Raw Water Bypass
Project was held before the Board of Directars of the Paradise Irrigation District on
February 21, 2007; and
Wl-IEREAS, the Board of Directors considered public comment at this hearing
and adopted a set of mitigation measures that were executed during the implementation
of the project, which has been completed; and
WHEREAS, the Board of Supervisors has considered the staff report and
recommendation of the Butte County Department of Water and Resource Conservation
and the Butte County Department of Development Services, Planning Division, and
public comments.
NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of

I. C'ertilies that it has reviewed and a~nsidered the Mitigated Negative Declaralir~n
fur the Magalia Raw Water Bypass Project prepared by Paradise Irrigation
District.
11. Finds the Mitigated Negative l~)eclaration to he adequate for the purpose of
entering into the agreement for grant funding with the Department of~ Water
Resources.
III. Finds that there are no non-mitigated significant impacts within the jurisdiction af~
the Board o1'Supcrvisors idcnti[icd in the Mitigated Negative Declaration.
IV. Finds that there is no need for the Board of Supervisors to modify the agreement
with DWR to mitigate any potential impacts.
V. Authorises the Clerk of the Board to prepare and file a Notice cyf Determination.
