HomeMy WebLinkAbout08-152~~,~*~~ S U,pLn •i~~ ~0: ~ =~* .~: :~. r ~ -*~ j * : .~s.:~ : ~ •a •;•~,;covK~'s~.~ BOARD OF SUPERVi~` RS COUNTY OF BUTTE, STATE OF CALIFORNIA R~solttti~~r2 No.o~-l~z RESOLUTION OG' THE BOARD OF SUPCRVISORS OT' THC COUNTY OI' BUTTE VACATING A PORTION Or THC PUBLIC RIGHTS OF WAY A[.ONG 6TH STRCET AND SHASTA AVENUE, THCRMALITO, OROVILLE, CALIFORNIA WHEREAS, a public hearing was held before the Board of Supervisors of the CowZty of Butte, State of California, on November 4, 2008, in the Board Chambers, Butte County Administration Building, 25 County Center Drive, Orovillc, California; and WHEREAS, notice of the time and place of the hearing on the request for the vacation was duly and --egularly given as required by law; and WHCREAS, the Planning Commission considered and adopted a Mitigated Negative Declaration prepared for the Tentative Parce] Map 07-0024 and Road Abandonment (Vacation) RA08-0003 for Quesada in accordance with the California Environmental Quality Act; and WHCREAS, said Mitigated Negative Declaration did not identify any impacts or require any mitigation measures for Road Abandonment (Vacation) RA08-0003; and WHEREAS, the Planning Commission has considered this vacation, and found the request consistent with the Butte County General Plan as stated in Planning Commission Resolution 08-45; and WHEREAS, testimony and evidence, both oral and documentary, was received by the Board. NOW, THCREFORE, BE iT RCSOLVEU by the Board of Supervisors: 1. The proposed vacation of these public rights of way does not have a significant effect on the environment. 2. The proposed vacation is in conformance with the Butte County General Plan. 3. The public rights of way in question, as hereinafter described, arc unnecessary for present o-• prospective public use. 4. The public rights of way situated in the County of Blrtte, State of California, as hereinafter more particularly described, are hereby vacated pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 5. The said public rights of way so vacated are looted in the unincorporated area of the County of Butte, State of California, are identified as a portion of 6th Street and Shasta Avenue, Thermalito, and are more parCicularly described in the attached Exhibit A. The lands described in Cxhibit A, are to be combined with and become a part of those lands as described in the deed t~ David J. (~uesada and Karen C~uesada as filed for record in E3uttc County Official Records at Serial IJumber 2005-0020811, and cannot be sold separately. No additional lots or parcels are created hereby. 6. The map showing the public rights of way hereby vacated is on file in the Office of the Butte County Department of Public Works, 7 County Center Drive, Oroville, California X5965. 7. The Clerk of this Board shall cause a certified copy of this resolution, with the seal of the Board of Supervisors of the County of C3uttc, State of California, to be recorded in the ~ftice of the Recorder of the County of Butte, State of California.
