Resolution No. 09-006
WHEREAS, Public Resources Code (PRC) Sections 42800 et seq. established the waste fire
program for the Slate of California and assigns responsibility for its implementation to the California
Integrated Waste Management ~3oard (CIWM[3); and
WHEREAS, PRC SeCtlon 42889(c) allows the CIWM13 to expend available money in the California
"hire Recycling Management Pund to pay the costs of cleanup, abatement, or other remedial action
related to the disposal of used whole tires; and
WHEREAS, procedures established by the State of California and adopted by the CIWMf3 require
the jurisdiction-applicant to certify by resolution the approval of the_jw-isdiction's governing authority
for submittal of a grant application belore submission of said application to the CIWMB; and
W1~EREAS, a cooperative regional approach for the collection, disposal, public education and
outreach for waste tires is deemed to the be the most efficient and cost effective means for local
government to address the problem posed by these wastes; and
WHEREAS, if awarded, the applicant will enter into a Grant Agreement with the California
Integrated Waste Management Board for implementation of said grant;
NOW, THEREFORE, BE IT RESOLVED that the County of Butte authorizes the Rural Counties
Environmental Services Joint Powers Authority to submit to the California Integrated Waste
Management Board a regional application for the l,~~cal Government Waste'[~ire Cleanup and
Amnesty Event Grant-}~Y 2008/09 (TCA4 Cycle) on its behalf. Rural Counties Environmental
Services Joint Powers Authority is hereby authorized acid empowered to execute all bract documents
necessa-y to secure grant funds and implement the approved grant project.
BE 1T FURTHER RESOLVED that this authorization is effective for the Waste Tire Grant ('fCA4)
with a term from June 30, 2009 to June 30, 2010.
