Resolution Amending Resolution 04-057 Authorizing the Creation of the County of Butte
Indian Gaming Local Community Benefit Committee
WHEREAS, on April 13, 2004, the Board adopted Resolution 04-057, authorizing the
creation of the County of Butte Indian Gaming Local Community Benefit Committee {"the
Committee"} in accordance with SB 621, codified in part through California Government Code
Sections 12710-12718; and
WHEREAS, pursuant to the reyuirernents of California Government Code Sections
12710-12718, Resolution 04-057 established the seven (7) member Committee; and
WHEREAS on September 30, 2008, AB 15$ was chaptered amending California
Government Code Sections 12712, 12715, 12716 and 12718; and
WHEREAS amendments to Government Code Section 12715 require the County to alter
the composition of the Committee to adhere to the requirements of that section; and
WHEREAS, such amendments provide that the Committee shall be composed of seven
(7} representatives, including two (2} representatives from the County, selected by the County
Board of Supervisors; three {3) elected representatives from cities located within four miles of a
tribal casino in the County, selected by the County Board of Supervisors; and two (2)
representatives selected upon recommendation of a majority of the tribes paying into the Indian
Gaming Special.Distribution Fund.
However, if only one city is within four miles of a tribal casino and that same casino is
located entirely within the unincorporated area of that particular county, only one elected
representative from that city shall be included on the Indian Gaming Local Community Benefit
Committee; and two {2} representatives selected upon the recommendation of a majority of the
tribes paying into the Indian Gaming Special Distribution Fund;
AND WHEREAS in Butte County there is cwnrently only one city located within four
miles of any tribal casino and those same casinos are located entirely within the unincorporated
area of the County of Butte as provided for in California Government Code Section
12715{b)(2){B}; therefore in Butte County the number of elected representatives from cities
located within Four miles of any tribal casino shall be reduced from three (3) to one (1), resulting
in the total Committee membership number being reduced from seven {7) to five (5) members
until such time as the number of cities within four miles of any casino exceeds one.
NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors
amends the composition of the County of Butte Indian Gaming Local Caznmunity Benefit
Committee to conform it to the requirements of California Government Code Section 12715 by
reducing the Committee from seven (7) members to five (5).
