RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO NEGOTIATE AND
ENTER INTO AGREEMENTS FOR ACQUISITION OF REAL PROPERTY FOR
PUBLIC ROAD PURPOSES AND AGREEMENTS FOR TEMPORARY
CONSTRUCTION EASEMENTS FOR THE
LOWER WYANDOTTE ROAD SAFE ROUTES TO SCHOOL (SR2S} PR03ECT,
COUNTY PROJECT NUMBER 23513-06-1
WHEREAS, the Butte County Department of Public Works is charged with the
responsibility for studying, recommending, constructing, and maintaining improvements within
the system of County of Butte roadways; and
WHEREAS, the County of Butte and the Department of Public Works has pursued and
been awarded grant funding through the Cycle 7 of the State authorized Safe Routes to School
{SR2S) Program far a proposed project to install curb, gutter, sidewalk, tie-in pavement, and
associated storm drainage improvements at the intersection of Monte Vista Avenue and Lower
Wyandotte Road and approximately 1,500 feet along the west side of Lower Wyandotte Road
southward to Golden Hills Drive; and
WHEREAS, the Lower Wyandotte Road Safe Routes to School (SR2S} Project for the
construction of curb, gutter, sidewalk, tie-in pavement, and associated storm drainage
improvements appears on the County of Butte Capital hnprovement Project {CIP) List, as
approved by the Butte County Board of Supervisors; and.
WHEREAS, the Butte County Department of Public Works has obtained environmental
clearance for the project as required under the California Environmental Quality Act {CEQA)~
Guidelines; and
WHEREAS, the County of Butte must complete all right of way and easement
acquisitions prior to construction of the proposed Lower Wyandotte Road Safe Routes to School
{SR2S} Project; and
WHEREAS, the Butte County Department of Public Works has determined that the most
expeditious method of clearing title and acquiring right of way and easements for the project is
for the right of way acquisition to be processed by the Butte County Department of Public Works
staff
NOW THEREFORE. BE IT RESOLVED, by the Board of Supervisors of the County
of Butte, State of California, in order to expedite the acquisition of the right of way and
temporary construction permits, authorizes the Director of Public Works to negotiate and sign
the Agreements for Acquisition of Real Property for Road Purposes and Agreement for
Temporary Construction Easements for the Lower Wyandotte Road Safe Routes to School
(SR2S} Project, County Project No. 23513-06-1.

California, this 24th day of March , 2009, by the following vote:
