HomeMy WebLinkAbout09-046RESOLUTION FOR THE DISPOSITION OF THE BIGGS VETERANS MEMORIAL HALL AND ITS COMMITTEE WHEREAS, the County ofi Butte, hereinafter referred to as "County", owns the property and improvements known as the "Biggs Veterans Memorial Hall" located at 280 B Street, Biggs, California, that, pursuant to the provisions of the California Military Veterans Code Section 1266, has been dedicated to and utilized as a Veterans Memorial Hall since its construction on August 22, 1949; and WHEREAS, the Biggs Veterans Memorial Hal! Committee, hereinafter referred to as "Committee", .was formed by the Board of Supervisors and is governed by regulations adopted by the Board of Supervisors on December 8, 1981; and WHEREAS, the Veterans of Foreign Wars (VFW) Russell Baker Post 3811, Biggs, California being the only remaining Veterans organization using the Memorial Hall, and having a declining membership, communicated with the Commander of the VFW Post 5731, Gridley, California and proposed a merger of the two posts; and WHEREAS, on October 9, 2008, the consolidation of the two posts was approved by the Veterans of Foreign Wars of the United States Department of California, the newly consolidated Post being known as VFW Warren H. McCutcheon post 5731, Gridley, California; and WHEREAS, as provided for in California Military Veterans Code Section 1266, the Committee, together with the officers and the majority of the members of VFW Post 3811, Biggs, California agree to the ac#ion of the County enacted by this resolution, and hereby relinquish use of the facility and ali rights to the Biggs Veterans Memorial Hall, including retention or disposal of the Biggs Veterans Memorial Hall, and to the dissolution of the Committee; and WHEREAS, the County agrees to the conditions requested by the Committee and shown below; NOW THEREFORE, BE IT RESOLVED that as provided for by California Military Veterans Code Section 1266 the Board of Supervisors of the County of Butte, State of California hereby revoke the dedication of the Biggs Veterans Memorial Hall, dissolve the Biggs Veterans Memorial Hal[ Committee, and authorize the Chief Administrative Officer to prepare and execute all necessary documents to carry out the fallawing conditions: 1. Recordation of a deed restriction, in perpetuity, by the Recorder of the County of Butte stating that the property shall be known as the Russell Baker Memorial Site and that future use shall be far the benefit of the Community, 2. Purchase of a plaque by the County and its placement on the property to memorialize the Baker family's contribution to the Community, and 3. The transfer of personal property belonging to the Biggs Veterans Memorial Hall to the Gridley Veterans Memorial Hall for its use and benefit. Hall Dear Mr. Hunsicker: The officers of the Veterans of Foreign Wars Russell Baker Post 3811, Biggs, California recognized that they were the only remaining Veterans organization using the Biggs Veterans Memorial Hall, that their membership was dwindling and that there was an urgent need to take action to avoid the potential abandonment of the Hall. To that end, they communicated with the Commander of the VFW Post 5731 located in Gridley, approximately 5 miles to the South and proposed a consolidation of the two pasts. On October 9, 2008, the consolidation was approved by the Department Commander and Commander-in-Chief of the Veterans of Foreign Wars of the United States Department of California. The newly consolidated post is known as VFW Warren H. McCutcheon Post 5731, Gridley, California. Following the consolidation of the two posts, and after careful consideration, the Biggs Veteraus Memorial Hall Committee, together with the majority of the members of VFW Post 381 1, Biggs, California determined to relinquish all right to the facility know as the Biggs Veterans Memorial Hall at 280 B Street in Biggs upon the following conditions: That a deed restriction, in perpetuity, be recorded by the Recorder of the County of Butte stating that the property shall be known as the Russell Baker Memorial Site and that future use of the site shall be for the benefit of the Community. That the County place a plaque on the property to memorialize the Baker family's contribution to the Community. That all personal property, including, but aot limited to, the chairs, tables, carts, dinnerware, kitchen stove, refrigerator, etc. be offered to the Gridley Veterans Memorial Ha!! for its use and benefit. It is the hope of the Biggs Veterans, that by relinquishing our right to a facility that is used very little, that the County wi11 be in a better position to safeguard the remaining halls for the benefit of all Veterans.
