HomeMy WebLinkAbout09-061Resolution RESOLUTION AUTHORIZING THE PUBLIC HEALTH OFFICER TO APPOINT A DEPUTY PUBLIC HEALTH OFFICER WHEREAS, the Butte County Public Health Department does not currently have a position allocated to serve as the Public Health Offcer when the appointed Public Health Officer for the County of Butte is on vacation or is otherwise unavailable to perform the duties of the office; and WHEREAS, there are qualified persons who are not residents of the County of Butte but axe willing to serve as Deputy Public Health Officer on an interim basis in the event of the Public Health Officer's unavailability; and WHEREAS, Government Code sections 1190 and 24101 authorize county officers to appoint qualified deputies, and Government Code section 1194 provides that such deputies have the same powers as their appointing authority ;and WHEREAS, Government Code section 25300 requires the board of supervisors to provide for the number, compensation, tenure, appointment and conditions of employment of county employees. NOW, THEREFORE, BE IT RESOLVED, that the duly appointed Public Health Officer for the County of Butte is hereby authorized to appoint a Deputy Public Health Officer to serve on an interim basis during the absence of the Public Health Officer, provided the Deputy Public Health Officer is a graduate of a medical college of good standing and repute. BE IT FURTHER RESOLVED that a Notice of Appointment of Public Office will be completed and signed by the Public Health Offzcex that will indicate the position and term of appointment. BE IT FURTHER RESOLVED that an Oath of Off ce of Public Employee (Government Code Section 1360) will be recited and signed by the appointed Deputy Public Health Officer. BE lET FURTHER RESOLVED that all individuals appointed to the position of Deputy Public Health Officer will be covered by County of Butte medical malpractice insurance for the term of the appointment. SE l1T FURTHER RESOLVED, as authorized by Government Code section 24001, the Board of Supervisors finds that it is in the interests of the County of Butte to waive the requirement that the Deputy Public Health Officer be an elector of the County of Butte, and hereby waives such requirement. BE YT FURTHER RESOLVED that in the event the Public Health Off cer is not able to secure the voluntary service of a Public Health Officer in an adjacent or nearby county, compensation of the Deputy Public Health Officer shall be established by contract approved in conformity with requirements set forth in the County of Butte Purchasing Manual.
