ADOPTING A NEGATIVE DECLARATION
FOR ZCA08-0002 (HORIZON/VERIZON}
WHEREAS, an Initial Study was prepared to evaluate potential impacts from Zoning
Code Amendment ZCA08-0002 in accordance with the California Environmental Quality Act
(CEQA} and identified no significant impacts resulting from the project; and
WHEREAS, the Planning Commission Resolution No. PC-25 recommends adoption of a
Negative Declaration pursuant to CEQA and approval of a zoning code amendment to amend
Butte County Code section 24-252, to establish a process for setback modification requests; and
WHEREAS, a duly noticed public hearing was held before the Butte County Board of
Supervisors on July 21, 2009; and
WHEREAS, the Board has considered public comments and a report from the Planning
Division:
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors:
I. Adopt a Negative Declazation with the following findings:
A. An Initial Study was completed in compliance with the California Environmental
Quality Act. Said study identif ed no significant environmental effects; a
Negative Declaration is adopted.
B. The Board of Supervisors has considered the Initial Study and Negative
Declaration, together with comments received during the review process.
C. On the basis of the whale record before the Board of Supervisors including the
Initial Study and any comments received, there is no substantial evidence that the
Zoning Code Amendment ZCA08-0002, would have a significant effect on the
environment. The custodian of the record is the Butte County Department of
Development Services. The location of the record is 7 County Center Drive,
Oroville CA 95965.
D. The Negative Declaration reflects the independent judgment and analysis of the
County, which is the Lead Agency.

II. The design of the proposed project improvements does not have the potential to
signif cantly impact the environment. A no Effect Determination pursuant to Fish and
Game Code Section 711.4 and 14 CCR 753.5. has been approved.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, on the 21st day of July, 2409, by the following vote:
AYES: Supervisors Dolan, Kirk, Lambert, Yamaguchi, and Chair Connelly
