A RESOLUTION OF THE BUTTE COUNTY BOARD Off' SUPERVISORS
RECOMMENDING DENIAL OF
GENERAL PLAN AMENDMENT GPAOG-0002, REZONE REZ06-0004
AND TENTATIVE SUBDIVISION MAP TSMOb-0011
WHEREAS, the Board of Supervisors has considered General Plan Amendment GPA06-0002
and Rezone REZ06-0004 for Charles Jones, in accordance with Chapter 24, Zoning, of the Butte County
Code on Assessor's Parcel Numbers 039-240-028 & 039-240-059; and
WHEREAS, the Board of Supervisors has considered Tentative Subdivision Map TSM06-0011
for Charles Jones, in accordance with Chapter 20, Subdivisions, of the Butte County Code on Assessor's
Paxcel Numbers 039-240-028 & 039-240-059; and
WHEREAS, the Board of Supervisors has considered the projects to be a Statutory Exemption
under Section 15270 in accordance with the California Environmental Quality Act; and
WHEREAS, said general plan amendment, rezone and map were referred to various affected
public and private agencies, County departments, and referral agencies for review and comments; and
WHEREAS, duly noticed public hearings were held on September 15, 2009 and December 8.
2009; and
WHEREAS, the Board of Supervisors has considered public comments, a report from the
Planning Division and the Planning Conunission recommendation.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors:
I. Find the projects are Statutorily Exempt from environmental review under CEQA Guidelines
Section 15270{a}. This section states that the California Environmental Quality Act exempts
projects which a public agency rejects or disapproves.
II. Find that the collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR
753.5 is not required.
III. Denies the General Plan Amendment, Rezone and Tentative Subdivision Map, pursuant to the
following findings:
A. The project is not consistent with the Agricultural Element, Land Use Element and
Durham-Dayton-Nelson Planning Area of the General Plan.
B. The project would cause a signifzcant impact to agricultural land on site and areas
adjacent to the project site.
C. The project is not consistent with the preferred land use alternative selected by the Board
of Supervisors for the General Plan 2030 update.
DULY PASSED AND ADOPTED this 8th day of December, 2009, by the following vote:
AYES: Supervisors Dolan, Kirk, Lambert, Yamaguchi, and Chair Connelly
