HomeMy WebLinkAbout10-010resolution WHEREAS, the Southgate Acres Subdivision map was recorded September 27, 1976 in Book 72 of maps at Pages IS and IG. Said Southgate Acres Subdivision Map contained an offer of dedication and grant in fee for public use for County road purposes Dunn Drive {currently known as Pistachio Drive) and Lewis Avenue (currently known as Gold Creek Way), said offer was not accepted at that time; and WHEREAS, The Southgate Acres Subdivision No. 2 map was recorded December 2, 19$0, in Book 80 of maps at Pages 34 and 35. Said Southgate Acres Subdivision Map contained an offer of dedication and grant in fee for public use for County road purposes Baja Court and Laguna Court, said offer was not accepted at that time; and WHEREAS, the roads within these subdivisions are currently private and the property owners would like the roads and storm drainage facilities to be accepted by the County for maintenance; and WHEREAS, Property owners within the above referenced subdivisions, who are also within County Service Area (CSA) 90 Zones 1 and 2, petitioned the County to establish a maximum service charge for storm drainage maintenance; and - WHEREAS, establishment of maximum service charges for storm drainage maintenance is necessary for the County to accept the roads and storm drainage facilities for maintenance; and WHEREAS, The new maximum service charge far storm drainage maintenance was established within CSA 90 Zones 1 and 2, pursuant to the provisions of Proposition 218, on June 9, 2009. The Board of Supervisors confirmed this new service charge with the adoption of Resolution 09-100, on June 9, 2009; and WHEREAS, the ballots for this new service charge included a request that the County accept the rights of way and roads into the County maintained mileage and take over maintenance of the storm drainage system; and WHEREAS, The storm drainage facilities and roads were improved to County standards for County maintenance, by Knife River Construction, formerly Baldwin Contracting. RESOLUTION ACCEPTING ROADS AND DRAINAGE FACILITIES WITHIN THE SOUTHGATE SUBDIVISION AND SOUTHGATE ACRES SUBDIVISION N0.2 INTO THE COUNTY MAINTENANCE SYSTEM NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AS FOLLOWS: 1. That this Board does hereby accept the offers of dedication as public roads, those particular roads known as Pistachio Drive (formerly Dunn Drive) and Gold Creek Way (formerly Lewis Drive}, and associated storm drainage facilities as shown and mare particularly set forth on the Subdivision Map for the Southgate Acres Subdivision, filed for record in the office of the Butte County Recorder, September 27, 1979, in Book 72 of Maps at Pages 15 and 16. 2. That this Board does hereby accept the offers of dedication as public roads, those particular roads known as Baja Court and Laguna Court, and associated storm drainage facilities as shown and more particularly set forth on the Subdivision Map far the Southgate Acres Subdivision No. 2, filed for record in the office of the Butte County Recorder, December 2, 1980, in Book 80 of Maps at Pages 34 and 35. 3.
