PROPOSED ORDINANCE ON 7,ONING AEFINITIONS
The Board of Supervisors of the County of Butte do, ordain as
follows:
The Board of Supervisors of the County of Butte have passed
various zoning ordinances in which various terms are used,
as follows:

The above numbered ordinances are hereby amended Ay adding
thereto the following:
In order to promote uniformity in the interpretation and
application or all zoning ordinances of the County of Butte, the
following definitions shall apply to such ordinances notwithstand-
ing any other ordinance or resolution to the contrary:
1. AGRICULTURE: The use of land for agricultural purposes,`
including farming, dairying, pasturage, agriculture, horticulture,
floricukture, viticulture, apiaries, and animal and poultry
husbandry, and the necessary accessory uses provided; however, that
the operation of any such accessory uses shall be secondary to that
of the normal agricultural activities. As used in this definition
"accessory use" means those supply, service, storage and processing
areas and facilities for any other agricultural land. The above

uses shall not include stock.yards_,__slaughter._houses,.hog__farms,^_
fertilizer works or plants for the reduction of animal matter.
2. ALL1_F~Y: Any public or private thoroughfare less than
forty feet in width which affords only a secondary means of access
to abutting property.
3. ANTIQUE'S, AND ANTIQUE' SHOP: "Antiques" means any article
which, because of age, rarity ar historical significance, has a

monetary value greater than the original value, or which has an age
recognized by the United States Government as entitling the article
to an import duty less than prescribed for contemporary merchandise
III A store or shop selling only such articles or offering them for sal
li shall ba considered as an antique shop or store, and not considered
as a dealership handling used or secondhand merchandise.
4. BUILDING: Any structure having a roof supported by
columns, or"`by walls and designed, intended and/or used as shelter
'for the enclosure of persons, animals, chattels, or for use in
commercial, industrial or other enterprises.
5. BUILDING, ACCESSORY: A detached subordinate building, the
use of which is incidental to that of the main building on the same
lot or to the use of the land:
6'. BUILDING, NON-CONFORMING: A building or structure or a
portion thereof lawfully existing at the time the zoning ordinance
affecting the property on which said building is situate becomas
effective which was designated, or structurally altered, for a use
that does not conform to the use regulations of the zoning. district
in which it is located.
7. DWELLING, SINGER FAMILY: A house,.including a guest house
as defined herein, occupied by one family, as defined herein-
8. DWELLING, MULTIPLE;; or MULTII'LR-DWELLING: A building or
portion thereof used and designated as a residence for two or more
families living independently of each other, including apartment
houses, duplexes, apartment-hotels and flats, but not including

automobile or trailer courts:
9. FAMILY: An individual or two or more persons related by
-.
blood or marriage or a group of'not more than six persons ~exclud-
ing servants) who need not be related by blood or marriage, living
togather in a dwelling unit.
10. F~'FD YARD, COMMERCIAL ANIMAL: A fenced or enclosed area
operated exclusively to fatten livestoc'~ for. clients for a cansid-,
eration, by being fed a concentrated ration...
11. EFNCS: "Fence" means a wall, or a barrier .connected by ~~
boards, masonry, rails, panels, wire or any other material for the
purpose of enclosing space or separating parcels of land. The ter
"fence" does not includQ retaining walls.
12. GARBAGE': Garbage means every accumulation of animal or
vegetable or other waste matter that attends or results from the
preparation, consumption, decay, dealing in, or storage o~ meat,
fish, fowl, fruits, vegetables or other food products, and shall
include any food container in which there is putresci.ble material
either solid or liquid.
13. HOML', BOARDING OR LODGING: A building or portion thereo
other than a hotel where meals for six ~6) or more persons are-
provided for compensation or profit.- ~: -- ;'-:
14. MOBILE' HOME, AUTOMOBILE: "Automobile Mobile-Home" means
a vehicle without motor power designed to be drawn by a motor
vehicle and to be used for human habitation, including -a trailer.
coach, tourist trailer or mobile home. Campers and any other self
propelled vehicle. having a body designed for or converted to the
same uses as a house trailer shall be considered to be an auto-
mobile house trailer and subject to the provisions of the zoning
ordinances with respect to house trailers.

15. HOG FARM: Any premises used exclusively for. the raising-
or kePOinQ of three (3) or more hods when raised, fed or .fattened
for the purposes .of sale and consumption by other than the owner

of the site. In .an agricultural zone the term "hog farm" is not.
intended to otherwise preclude the raising. of hogs as,a~part of a
general farming operation or as:an F.H.A., 4-H, or other student
:.

16. HOUSE;, GUEST: A detached living quarters of a permanent
type of construction containing not more than 500 feet in area,.
which does not contain .kitchen facilities and which is designed
for and used to house non-paying transients, visitors ar guests of
the occupants of the dwelling on the lot; and having a rear yard
and side yard of not less- than five (5) feet and located not less
than ten (10) feet from any other accessory building and not less
than eight (8) faet from any main building on the same lot.
17. HOSPITAL: Hospital means an institution specializing in
giving clinical, temporary and emergency, or long-term services of
a medical or surgical nature to human patients, and licensed by
State Law to provide facilities and services in surgery, obstetrics
and general medical practice.
18. HOTEL: Hotel means a building in which there are six (6)
or more guestrooms where lodging with or without meals is provid ed
for compensation, but shall not include jails, hospitals, asylums,
sanitariums, orphanages, prisons, detention homes and similar
buildings where-human beings are housed or detained under legal \
restraint.
19. INDUSTRY: The manufacture, fabrication, reduction or
destruction or any. article,_substance or commodity, or ang other
treatment thereof in such a_manner as to change the for.m..or
character thereof, including, in addition, the following: Animal
hospitals, bottling works; canneries; contractor's yards, building
materials; cleaning and dyeing establishments; creameries; dag
pounds; junk yards; laundries; lumber processing plants; lumber
yards; milk bottling o.r distributing stations; stockyards; storage
elevators; truck storage, service or repair; warehouses, and

wholesale storage; commercial feed yards; slaughter houses;
fertilizer works; and plants for the reduction of animal matter.
20. JUNK YARD: Junk yard means the use of more than 100
square feet of the area of any lot, or the use of any portion of
~~ that half of a lot which adjoins any street or highway, for the
storage of junk including scrap metals, salvage or other scrap
materials, or for the dismanteling or "wrecking" of automobiles
or other vehicles or machinery, whether for sale or storage.
21. KENNEL, BOARDING: Any premises, except where accessory
to an agricultural use, where four (4) or more adult dogs or cats,
not sick or injured, four (4) months in age or older are boarded
for compensation or cared for or trained for hire, or are kept for
sale or bred for sale.
22.. MOTEL: Motel means a group of attached or detached
buildings containing individual sleeping-; units wriere a majority
of such units open individually and directly to the outside, and
where a garage is attached to or a parking space is conveniently
located to each unit., all for the temporary use by automobile
tourists ar transients, and shall include tourist courts, motor
,courts, automobile courts, automobile camp and motor lodges.. A
'unit of a motel having kitchen facilities shall constitute a
dwelling unit and shall be subject to all of the provisions and
requirements of this ordinance governing dwelling units-for the
zoning in district in which the establishment is located.
23. OFFICES, PROFESSIONAL: Offices maintained and used as
a part of business conducted by persons engaged in one of the
professions, limited to medical doctors, dentists, engineers,
attorneys, architects, real estate brokers, accountants, optome-
trists, doctors of chiropractic., insurance, stock brokers; and
licensed as such by the State of California.
24. PARK, MOBILE HOME, TRAILER,. ETC: Mobile home park and
trailer park means any area or tract of land used for or designed

to accomodate two {2} or more automobile house trailers, mobile
homes, or tourist trailers, and including trailer camps, all as
defined by County Ordinance No. 681.
25. PARKING SPACE:: An accessible and useable paved or gravel
', ed space on a building site at 1Aast ten feet by twenty feet locate

off the street, but not occupying any part of any required front
yard or in the side yard on the street side of a corner lot, with
access of not less than twelve feet, for the parking of automobiles
~ 26. PLANT, AGRICULTURAL PROCESSING: Means the necessary
accessory uses to agriculture to prepare grown products in their
natural state for desirous marketability, such as nut hulling plant
prune dehydrators and the supply, service, storage, and receiving
stations of such products. The above uses shall not include stock
yards,.commercial feed yards, canneries, slaughter houses, ferti-
lizer works~or plants for the reduction of animal matter.
27. PLANT, CONCRETE, ASPHALT BATCH, SAND AND GRAVEL: Means
the necessary facilities to prepare sand, gravel, cement, asphalt
and liquid asphalt into construction components, used by contract-
ors, builders, home owners and governmental agencies in building
construction, sidewalks, curbs, gutters, bridges, streets and
highways.
28. R~;FUSE: Refuse shall mean and include any solid or semi-
solid waste other than domestic sewage including, but not limited
to, garbage, rubbish and trash.
29. RUBBISH:: Rubbish shall mean~all non-putresciblP solid
wastes, combustible or non-combustible, including but not limited
to paper, cardboard., yard clippings, grass, ashes, wood,"bedding,
crockery, glass, metal and similar materials.
30. SECONDHAND STORE': Secondhand store means any retail
establishment in which the principal portion of the articles,
commodities or merchandise handled, offered for sale, or sold on
the premises are not new. Secondhand stores shall not be consid-

ing gasoline, oil and minor accessories and services for automob-
ila.s.
32. SIGNS, OUTDOOR ADVF,RTTSTNG: A structure of any kind or
character erected and maintained for out-door advertising purposes
which is not appurtenant to the property it occupies.
33. STABLR, PRIVATE: Private stable means a detached access-
ory building in which horses or other beasts of burden owned by the
occupants of the premises are kept.
', 34. STABLE, PUBLIC OR RIDING: A stable other than private
stable, generally where horses are available for hire.
35. STRUCTUR:l+;: That which is built ar constructed, an
edifice or building of any kind, or any piece of work, artificially:
built up or..composed of parts joined together in some definite
manner.
36. SWILL: Swill shall mean that particular garbage which is
wholly, or nearly so, edible and useable as food and having-food
value for animals or fowl, accumulating from animal, vegetable, or
other matter wasted from clubs, hospitals, hotels, markets, restau-
rants,,and public eating places.
37. USF, PUBLIC: A use operated exclusively by .a public body
having the purpose of serving the public health, safety, or general
welfare, and including such uses as public schools, parks, play-
grounds, hospitals, and administrative and service facilities.
3B. USE, QUASI PUBLIC: A use operated by a private. non-profi
educational, religious, recreational, charitable, fraternal, or
medical institution, association, or organization; said use having
the purpose primarily of serving the general public, and including
but not limited to such uses as churches, private schools., univer-
sities, community youth and senior citizen recreational facilities,
meeting halls, private hospitals and the like.

39. ZONE: An area accurately defined as to boundaries and
location and classified by the zoning ordinance as available for
certain types of usPS as set forth in this ordinance and within ,
which other types of uses are excluded.
This ordinance shall take effect thirty C30) days after the
date of its adoption, and before the expiration of fifteen (15)
days after its passage, it shall be published with the names of
the members voting for and against the same, once, in a newspaper
published in the County of Butte, State of Galifarnia.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte this 19th day of November 1568, by the
following vote:
