Home My WebLink About10-020Resolution A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE AUTHORIZING THE CHAIR OF THE BOARD OF SUPERVISORS TO SIGN THE MASTER PROPERTY TAX TRANSFER AGREEMENT WITH THE BUTTE WATER DISTRICT WHEREAS, Section 99, Subdivision (b), Paragraph (S) of the Revenue and Taxation Code provides as follows: In the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the board of supervisors of the county or counties in which (the} districts are located shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. WHEREAS, the Revenue and Taxation Code further provides in Section 99.01, Subdivision (a), Paragraph (3): Notwithstanding the provisions of paragraph (5) of subdivision (b) of Section 99, any special district affected by the jurisdictional change may negotiate on its awn behalf, if it so chooses. WHEREAS, Section 99 fixrther provides in Subdivision (d): With respect to adjustments in the allocation of property taxes pursuant to this section, a county and any Iocal agency or agencies within the county may develop and adopt a master property tax transfer agreement. Such agreement may be revised from time to time by the parties subject to such agreement. WHEREAS, the Butte Water District wishes to enter into a revenue neutral master property tax transfer agreement with Butte County to allow the District to freely annex property without entering into separate agreements for each annexation. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: 1. This Board agrees that no property tax transfer will occur as a xesult of any annexation of territory to the Butte Water District. 2. The Chair of the Board of Supervisors is directed to execute the Master Property Tax Transfer Agreement.
