HomeMy WebLinkAbout10-023Resolution Resolution authorizing the County of Butte to act as Lead Agency for the submittal of the Local Government Waste Tire Cleanup and Amnesty Day Grant Application, FY 10111 WHEREAS, Public Resources Code (PRC) Sections 42800 et seq. established the waste fire program for the State of California and assigns responsibility for its implementation to the California Department of Resources Recycling and Recovery (CalRecycle); and WHEREAS, PRC Section 42889(e) allows the California Department of Resources Recycling and Recovery to expend available money in the California Tire Recycling Management Fund to pay the costs of cleanup, abatement, ar other remedial action related to the disposal of used whole tires; and WHEREAS, procedures established by the State of California and adopted by CalRecycle require the jurisdiction-applicant to certify by resolution the approval of the jurisdiction's governing authority for submittal of a grant application before submission of said application to CalRecycle; and WHEREAS, a cooperative approach with special districts within Butte County for the collection, disposal, public education and outreach for waste tires is deemed to the be the most efficient and cost effective means for local government to address the problem posed by these wastes; and WHEREAS, if awarded, the applicant will enter into a Grant Agreement with the California Department of Resources Recycling and Recovery for implementation of said grant; NOW, THEREFORE, BE IT RESOLVED that the County of Butte authorizes the Department of Public Works to submit to the California Department of Resources Recycling and Recovery an application for the Local Government Waste Tire Cleanup and Amnesty Event Grant-FY 2009110 (TCA6 Cycie} on its behalf The Butte County Department of Public Works Director is hereby authorized and empowered to execute all grant documents necessary to secure grant funds and innplement the approved grant project. BE J(T FUR.THER RESOLVED that this authorization is effective for the Waste Tire Grant (TCA6) with a term from receipt of the Notice to Proceed until the end of the grant reporting term, Septerrzber 30, 2011.
