A RESOLUTION APPOINTING ASSESSMENT COMMISSIONERS
FOR THE ROCK CREEK RECLAMATION DISTRICT
WHEREAS, the Rock Creek Reclamation District ("District"} was
formed, pursuant to Board of Supervisors Resolution SS-167 and Division
15 of the California Water Code {sections 50000 et seq.), in 1985; and
WHEREAS, the District wishes to levy an assessment upon property
owners within the District to pay the capital, operation and maintenance
expenses of District facilities and improvements; and
WHEREAS, the District has requested that the Board of Supervisors
("Board") of the County of Butte appoint three independent and
disinterested Assessment Commissioners ("Commissioners") to facilitate in
lawfully and appropriately apportioning the assessment among the parcels
within the District; and
WHEREAS, the qualifications to be a Commissioner are set forth in
Water Code section 51230 and include that a Commissioner have no interest
in real estate within the District and will perform his duties to the best of his
ability; and
WHEREAS, the sole role for the Board in this process will be the
appointment of three Commissioners after which the remainder of the
process of levying an assessment will be carried on by the District pursuant
to Proposition 21 S; and
WHEREAS, the District has contacted three individuals, Clay
Castleberry, Fred Davis and Ed McLaughlin, none of whom have any
interest in real estate within the District, and all of whom are qualified to
serve as Commissioners by virtue of their training and experience; and
WHEREAS, Mr. Castleberry, Mr. Davis and Mr. McLaughlin have
each agreed to serve as a Commissioner and each has given the District a
range of reasonable hourly pay rates which he would accept to perform the
duties set forth above; and
WHEREAS, the District has determined that the range of hourly pay
rates which would be acceptable to each of the three prospective
Commissioners is reasonable.
NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF
SUPERVISORS:
Appoints pursuant to the qualifications set forth in Water Code section
51230 Clay Castleberry, Fred Davis and Ed McLaughlin as Assessment

Commissioners, to perform the duties of determining an assessment value
per acre for each parcel within the District which is in proportion to the
benefits to be derived from District facilities (as currently constructed or
hereinafter proposed} and District services, pursuant to Proposition 218.
DULY PASSED AND ADOPTED by the Board of Supervisors of
the County of Butte, State of California, on the a 3 day of
