Resolution
WHEREAS, The property owners have submitted a request and petition to summarily
vacate Public Utility Easements serving lots 24 through 29 of the Thengvall Tract Unit One in
the town of Richvale; and
WHEREAS, these Public Utility Easements were offered for dedication, but not
formally accepted on the subdivision map of the Thengvall Tract Unit One, which was filed far
record April 10, 1963, in Book 30 of Maps at Pages 11 through I3; and
WHEREAS, the easements have not been used by the public utilities and there has been
no acceptance of the offer of dedication in more than 25 years; and
WHEREAS, the public utilities have provided written confirmation that they do not
object to the vacation of these Public Utility Easements; and
WHEREAS, pursuant to the Streets and Highways Code Section Division 9, Part 3,
Chapter 4, commencing with Section No. 8333, the board finds that. these Public Utility
Easements should be summarily vacated;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County
of Butte, State of California, as follows:
1. The Public Utility Easements as described in Exhibit A and shown on Exhibit B, attached
hereto, are hereby summarily vacated and abandoned pursuant to the Streets and
Highways Cade Division 9, Part 3, Chapter 4, commencing with Section No. 8333;
2. That the Clerk of this Board shall cause a certified copy of the Resolution, with the seal
of the Board of Supervisors of the County of Butte, State of California, to be recorded in
the Office of the Recorder of the County of Butte, State of California.
3. That from and after the date the Resolution is recorded, the said vacated Public Utility
Easements shall no longer constitute public utility easements.

PASSED AND ADOPTED by the Butte County Board of Supervisors this 25th day of May,
2010, by the following vote:

DESCRIPTION OF
THE PUBLIC UTILITY EASEMENT
TO BE VACATED
All that real property situate in the County of Butte, State of California, described as
follows:
A portion of that Public Utility Easement across Lots 24 through 29, as shown on that
certain map entitled "Thengvall Tract -Unit One" filed for record April 10, 1963, in
Book 30 of Maps, at page 11, in said Recorder's Office, the westerly line of said
Easement portion being more particularly described as follows:
BEGINNING at the northeast comer of Lot 19, as shown on said map entitled ThengvalI
Tract -Unit One", said point being on the westerly line of said Lot 24;
Thence along the westerly line of said lots 24, 2S, 26, 27, 2$ and 29, North 14°59'00"
West 425.00 feet to the most westerly corner of said Lot 29 and the terminus of said
Easement.
