HomeMy WebLinkAbout10-086IN THE TOWN OF RICHVALE Resolution WHEREAS, The property owners have submitted a request and petition to summarily vacate Public Utility Easements serving lots 24 through 29 of the Thengvall Tract Unit One in the town of Richvale; and WHEREAS, these Public Utility Easements were offered for dedication, but not formally accepted on the subdivision map of the Thengvall Tract Unit One, which was filed far record April 10, 1963, in Book 30 of Maps at Pages 11 through I3; and WHEREAS, the easements have not been used by the public utilities and there has been no acceptance of the offer of dedication in more than 25 years; and WHEREAS, the public utilities have provided written confirmation that they do not object to the vacation of these Public Utility Easements; and WHEREAS, pursuant to the Streets and Highways Code Section Division 9, Part 3, Chapter 4, commencing with Section No. 8333, the board finds that. these Public Utility Easements should be summarily vacated; NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of the County of Butte, State of California, as follows: 1. The Public Utility Easements as described in Exhibit A and shown on Exhibit B, attached hereto, are hereby summarily vacated and abandoned pursuant to the Streets and Highways Cade Division 9, Part 3, Chapter 4, commencing with Section No. 8333; 2. That the Clerk of this Board shall cause a certified copy of the Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the Office of the Recorder of the County of Butte, State of California. 3. That from and after the date the Resolution is recorded, the said vacated Public Utility Easements shall no longer constitute public utility easements.
