RESOLUTION OF THE BOARD OF SUPERVISORS
OF THE COUNTY OF BUTTE APPROVING THE APPLICATION FOR GRANT
FUNDS FROM CALIFORNIA DEPARTMENT OF CONSERVATION'S
CALIFORNIA FARMLAND CONSERVANCY PROGRAM FOR '145 ACRES
OFF HEGAN LANE {COMANCHE CREEK EASEMENT}
WHEREAS, the Legislature has established the California Farmland
Conservancy Program within the Department of Conservation and through a
grant program is providing assistance to conserve important agricul#ural land
resources that are subject to conversion pressures; and
WHEREAS, the adopted Butte County General Plan contains policy "to
provide for the Fong term protection of agricultural resources of the Chico Area of
Butte County," "to mitigate the threat to agricultural resources posed by urban
encroachment into and conversion of agricultural lands in the Chico Area," and
"to reduce agriculturallurban conflicts in the Chico Area of Butte County; {LUE-
7$)" and
WHEREAS, lands in the vicinity of the Comanche Creek Easement, west
of the City of Chico in unincorporated Butte County have experienced and will
continue to experience non-agricultural development pressures; and
WHEREAS, the Northern California Regional Land Trust {NCRLT) intends
to acquire an agricultural conservation easement on '145 acres of agricultural
lands located %z mile west of the Gity of Chico's western sphere of influence
boundary, aka 'Greenline' for the purpose of conserving priority agricultural land
rsources_
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors makes
the following findings relative to the subject property, approves of the filing of an
application for funding from the California Farmland Conservancy Program, and
certifies that the easement meets the eligibility criteria set forth in Public
Resources Code Section 1 U251.
A. The parcel proposed for conservation is expected to
continue to be used for, and is large enough to sustain,
commercial agricultural production.
B. The land is located in an area that possesses the necessary
market, infrastructure, and agricultural supporl services; as
well as adjacent land uses, to support long-term commercial
agricultural production.
C. Butte County has a general plan which demonstrates a long-
term commitment tv agricultural land conservation. This
commitment is reflected in the goals, objectives, policies,
and implementation measures of the plan as they relate to
the area of Butte County where the easement acquisition is
proposed.
D. The grant proposal is consistent with the Butte County
general plan, and the governing body of Butte County
approves the grant proposal.
E. Without conservation, the land proposed for protection is
likely to be converted to Non-agricultural use in the
foreseeable future.
F. Finds the project categorically exempt from the provisions of
the California Environmental Quality Act (CEQA} pursuant to
section 15325{b) Transfers of Ownership of interest in Land
to Preserve Existing Natural Conditions (class 25}. The
requested resolution supports "acquisition, sale, or other
transfer of areas to allow continued agricultural use of the
areas"
PASSED AND ADOPTED by the Butte County Board ofi Supervisors on this 22nd
day of June, 2010, by the following vote:
