CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR BUTTE
COUNTY GENERAL PLAN 2030
WHEREAS, the Butte County General Plan 2030 (GP 2030) Update process was
initiated by action of the Board of Supervisors, including the adoption of Resolution 06-085 on
May 23, 2006, which created the Butte County General Plan Citizens Advisory Committee and
set in motion a process of holding public workshops and meetings regarding the County's GP
2030 Update; and
WHEREAS, the Board of Supervisors held public meetings to consider the GP 2030
Update on May 8 and July 11, 2007; February 26, July 22, July 29, and July 30, 2008; February
18, February 19, April 14, May 29, August 25; and December 8, 2009; January 19, January 21,
April 13, July 27; August.24, September 14 and September 29, 2010; and
WHEREAS, the Planning Commission held public meetings to consider the GP 2030
~-Update on April 13, September 28, and October 11, 2007; May 9, May 30, June 13, July 22,
November 7, November 14, and December 11, 2008; January 19, January 21, 2010, and
September 9, 2010; and
WHEREAS, the Draft Environmental Impact Report (DEIR) (Stare Clearinghouse
Number 2008092062) was distributed on April $, 2010 to members of the Planning Cornmissian,
Board of Supervisors, state and local- agencies and special districts, property owners and others
requesting copies of the DEIR, and other interested groups and individuals. The DEIR and
Notice of Completion (NOC) were provided to the State Clearinghouse for distribution to state
agencies. The notice of public hearing was published in five local newspapers of general
circulation to begin a 60-day public review and comment period from April 8, 2010 to June 7,
2010, on the adequacy of the DEIR; and
WHEREAS, in conjunction with the release of the DEIR for the GP 2030 Update the
Planning Commission met on April 22, 2010, and received public comment on the DEIR, in
accordance with Butte County Environmental Review Guidelines; and
WHEREAS, on August 30, 2010, a Final Environmental Impact Report (FEIR) r~vas
released for the public's review. The FEIR included responses to all comments received on the
DEIR, including comments provided at the April 22, 2D10, Planning Commission meeting,
revisions to the DEIR, and a mitigation and monitoring reporting program; and
WHEREAS, on September 9, 2010, the Butte County Planning Commission conducted a
public hearing concerning the FEIR; and
WHEREAS, on September 9, 2010 the Planning Commission, under Resolution No. 10-
24, unanimously recommended that the Board of Supervisors certify the FEIR; and
WHEREAS, the Board of Supervisors has reviewed and considered in light of public
comments and testimony the information in the FEIR and staff reports for adequacy,
completeness and compliance with CEQA, and the State CEQA Guidelines.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby certifies
the FEIR for the fallowing reasons:
1. Notice of the Board of Supervisors hearings on the GP 203D environmental review
documents was given as required by law and the actions were conducted in accordance
with CEQA, and the State CEQA Guidelines.
2. All individuals, groups and agencies desiring to comment were given adequate
opportunity to submit oral and written comments vn the environmental review
documents. The opportunities for comment meet or exceed the requirements of CEQA.
3. All comments submitted during the public review and comment period on the DEIR were
responded to adequately.
4. The Board of Supervisors was presented with all of the information described in the
recitals and has considered this information in adopting this resolution.
5. The FEIR (a} has been completed in compliance with the intent and requirements of
CEQA and the State CEQA Guidelines, (b} reflects the independent judgment and
analysis of the County of Butte, which is the lead agency, and (c} has been presented to
and reviewed and considered by the Board of Supervisors in its deliberations regarding
the adoption of the GP 203D Update.
