'12 13. 14 15 16 l']' 18 ': 19 20 21 22 z3 24 25 26 27 28 29 30 37. 32 0~2DINANCE N0. ~ ~ AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ZONING A PORTION OF SAID COUNTY PURSUANT TO ORDINANCE NOS. 475, 522 AND 676 OF SAID COUNTY 1~URPOSE OF CLASSIFICATION: The principal objective and purpose to be served by this classification and its application is to create a living environment to the highest standards for single dwellings by means of the standards and requirements set forth herein and re- gard to minimum lot area, yards. and open spaces required to be main- tained, but to permit a form of domestic economy involving a combi- nation of a single-family dwelling and premises. A related con- sideration is to make it possible to more efficiently and economic- ally design, install and maintain all physical public service facil- ities in-terms of size and capacity to adequately and permanently meet needs resulting from a defined intensity of land use. Now, therefore, the Board of Supervisors of the County of Butte, State of California, do ordain as follows: SECTION 1. -The hereinafter described area situate in the County of Butte, State of California shall be and it is hereby zoned as an "R-1 A&C" (Minimum-Density Single-Family Dwellings, Arts & Crafts and Professional Classification) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specsfed and provided. Said area so zoned being lo- cated in the unincorporated area of Bette County, Paradise, Cali- fornia, particularly described as follows: As shown on map attached and as shown on Butte County Map No. 6A-1 in the Office of the Butte County Planning Commission and in the Office of the Butte County Clerk. SECTION 2. Regulations for "R-1 A&C" District: The following (regulations shall apply in an "R-1 A&C District: 2.1 USES PERMITTED: a. Single-family dwellings, not including tents or trailers. b. Accessory buildings pertinent to the permitted uses. c. The following uses-are.._considered..to bs accessory uses and -are permitted. in an Ft-1 A&C zone only .when conducted on the premise: 'with a residence occupied and used as a residence by the proprietor Hof such use, and no display or display window visible from a street (shall be permitted: 1. Domestic arts and crafts, including, but not limited 'Ito the following: a. ceramics, b. ne®dlework, c. dressmaking, d. art studio, including photography, i e. lapidarist, and. 2. Professional services shall conform to the following 'condit'ions: ', a. Not more than one (1) employee or assistant is en- ',gaged for work or service on. the premises in connection with such 'uses. ~ , b. One (1) single-faced, unlighted sign shall not ~~egceed three (3} square feet in area, used exclusively to advertise 'products made, services rendered or business conducted on the premises, and such signs shall not be located in any required yard. c. Not to ex teed-two (2) parking spaces in addition to those required for dwelling, provided such parking spaces shall. not be located in any required yard or open space. 1 2.2 MINIMUM LOT AREA: Minimum lot area required of a lot per dwelling. unit shall be 2 not less than eight thousand, one hundred twenty-five (8,125) square feet. 3 2.3 MINIMUM LOT WIDTH: Minimum lot width shall not be less than s~,xty-five (65) feet. 4 2.4 MINIMUM FRONT YARD: Minimum front yard shall be fifty (50) feet from the centerline 5 of the road; except--where the- road is classified by the County as a .Federal Aid Secondary Road, the minimum building setback required 6 shall be fifty-five (55) feet from the centerline of said road. 2.5 MINIMUM SIDE YARB: 7' Minimum side yards shall not be less than five (5) feet. 8 9 SECTION 3. All uses of land within the district not specifically authorized and permitted in Section 2 are prohibited. lo: SECTION ~. In compliance with the provisions of the Zoning Enabling Ordi- 11 Hance, the same is hereby amended by adding to Section 5 thereof, this ordinance in full. 12 ', sECTION 5. 13 '' The penalties for the violation of the zoning hereby imposed 14. 15! 16 ': l7 18' 19 20' 21 22: 23 24 2B: 26' 27 28 29 30' 31' 3S within. the district shall be as provided in the Zoning Enabling Ordinance.,~.In compliance with the provisions of the Zoning Enab- ling Ordinance, this ordinance shall be from and after its effect- ive date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 6. This ordinance shall be and it is hereby declared to be in full force from and after thir=ty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage ' this ordinance shall be published once with the names of the mem- bers of the Board voting for and against it in the a newspaper published in the County of Butte, State of Califo~r~nia.
