A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
REGARDING ADOPTION OF A NEGATIVE DECLARATION
FOR WIND TURBINE ZONING CODE AMENDMENT
ZCA10-0004 (Butte County)
WHEREAS, the Butte County Board of Supervisors directed the Department of
Development Services to ini#iate a zoning code amendment to regulate the design and
placement of wind turbines within the County; and
WHEREAS, an Initial Study was prepared and circulated for agency and public
comment from October 29, 2010 to November 30, 2010 consistent with the
requirements of the California Environmental Quality Act; and
WHEREAS, on November 18, 2010 in a public hearing, the Planning
Commission heard the zoning code amendment and public testimony thereto and made
a recommendation that the Board of Supervisors adopt the zoning code amendment;
and
WHEREAS, a duly noticed public hearing of the Board of Supervisors was held
on December 14, 2010; and
WHEREAS, the Board of Supervisors has considered report from the
Development Services Department, public and agency comments, and a
recommendation from the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors:
I. Adopts a Negative Declaration with the following findings:
A. An Initial Study was completed in compliance with the California
Environmental- Quality Act. Said study did not identify any significant
environmental effects.
DULY PASSED AND ADOPTED this 14t~' day of December 2010, by the following vote:
AYES: Supervisors Dolan, Kirk, Lambert, Yamaguchi and Chair Connelly
NOES: None
ABSENT: None
ABSTAIN: None
