AN ORDINANCE AMENDING ORDINANCE N0. 475

2 The Board of Supervisors of the County of Butte, State
3 of California, do ordain as follows:
4 1. Ordinance No. 475 is hereby amended by adding thereto
5 Section 18.1, which reads as follows:
g Whenever an application for change of zoning, use permit,..
q variance ar an expansion of a non-conforming use is declined in
g the legislative process as set out in this ordinance and amendments
g thereto,no new application for re-zoning, use permit variance,
10 or expansion of non-confirming use pertaining to part or all of the
11 property affected by said initial application may be filed for one
12 year from the date of the final decision thereon; provided, however,
13 that a new application may be filed where the applicant proves at
14 a public hearing as provided herein, that there has been a change
15 of circumstances in the surrounding areas which change of
16 circumstances occured after the final decision on the previous
17 application. A special public hearing shall be held on the
lg question of change of circumstances, which special hearing shall
lg be set, noticed and heard in the same manner as for a hearing for
20 change of zoning as set forth in Ordinance No. 475 as amended.
21 The application for said special hearing must be accompani-
22 ed by a fee of $100.00, payable to the County of Butte and said
23 fee of $100.00 shall b e forthwith deposited in the general fund
24 of the County of Butte.
2g The decision of the Planning Commission on the issue of
2g change of circumstances shall be final except that any interested
27 person may appeal the decision of the Planning Commission to the
2g Board of Supervisors, provided that a written notice of appeal is
29 filed with the Clerk of the Board of Supervisors within 5 days
30 of the decision of the Planning Commission.
3T This ordinance shall be and is hereby declared to be in
32fu11 force and effect from and after thirty (30) days after the

County of Butte, State of California, this 11th day of March,
1969, by the following vote:
