I4' 15! 16I 3.7 18' 19! 20 21 22 23 241 25 26 27 ~' 28 29; 30 31` 32iI ORDINANCE N0. /~27 AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING BUTTE COUNTY CORE SECTION 26-3, AMENDMENTS TO THE UNIFORM BUILDING CODE, 1964 EDITION, FOR THE COUNTY OF BUTTE, STATE OF CALIFORNIA. The Board of Supervisors of the County of Butte do ordain as follows: 1. Section 26-3 of the Code of Butte County, California, is hereby amended as follows: SEC. 26-3. SAME - AMENDMENTS, ADDITIONS AND DELETIONS. The Uniform Building Code adopted by section 26-1 is amende as follows: Section 204. Section 204 of the Uniform Building Code is hereby deleted. The local appeals board of the county which was established by Resolution No. 64-3 by the county board of super- visors shall hear any and all appeals regarding the application an enforcenenit of this chapter. ' Seetion 301(x). Add to subsection (a) of section 301 of the Uniform Building Code, the following paragraphs: "No permits shall be required for any agricultural building or structure. Agricultural buildings are defined as follows: "Agricultural building is a building located on agricultural property and used to shelter farm implements, hay, grain, poultry, :.`..livestock, or other farm produce, in which there is no human habitation and which is not used by the public." No permits shall be required for accessory buildings detached from a residence by at least six (6) feet and whose occupancy would be classified a Type J as defined in the 1964 Uniform Building Code. "Na permits shall be required under this ordinance (Ordin- ance No. 886) for industrial buildings located in industrial,:zones M-l and M-2 as established by ordinance. Industrial buildings are' defined as those buildings used for the manufacturing, processing, fabricating, assembling, refining, repairing, packaging, and treat- ment of goods, materials and products. (Riley Act building permits, plumbing and electrical permits shall,be required for these '' r l industrial buildings per Ordinances Nos. 887 and 888, and Section 2; 19130, Division 13, Part 3, of the California Health & Safety Code. 3 Building permit fee schedules for Riley Act permits shall be the !4! same as prescribed in Sectigri 303(b)., Table'3=A, as ;amended herein.'° 'S; Section 302(d). Section 302(d) of the Uniform Building 6i Code is deleted in its entirety and is amended as follows: '7 "Every building permit issued under the provisions of this 8 Code shall expire by limitation and become null and void after one 9' (1) year from the date of issuance of said permit. If building is 10 under constructiox~# before work can continue, a new permit shall 11; be first obtained and the fee therefor shall be one-half (2) the 12 amount required for the original permit; provided, no changes have 13 been made or will be made in the original plans and specifications 14 'for such work, If the building work authorized by a building per- 15 mit is not commenced within sixty (60) days from the date of 16 issuance, or if the building or work authorized by such permit is 17! abandoned or suspended at any time after work is commenced for a ~. 18: period of one hundred twenty (120) days, permittee shall so advise 19' the Building Department. Before such work can be recommenced, the 20; Building Department shall be so notified that work is to proceed 21.! and the building permit must be active. 22' '^If-the construction has not begun within the one (1) year 23'. period, the permit becomes null and void and a new permit appli- 24! cation and a full permit fee must be paid to reinstate the permit." 25 Section 303(b). Section 303(b) of the Uniform Building 26' Cade is hereby amended to exclude plan checking fees on single 27 family dwellings and duplexes as well as their appurtenant struc- 28 Lures. 29 Section 303(b), Table 3-A. Section 303(b), Table 3-A of the 30i' Uniform Building Code is hereby amended to read as follows: 31 , 32 2, 11 2 3 4 5 e 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Total Valuation $1.00 to $500.00 $501.00 to $2,000.00 $2,001.00 to $25,000.00 $25,001.00 to $50,000.00 $50,001.00 to $100,000.00 $100,001.00 and up Fee $5.00 $5.00 for the first $500.00 plus $1.00 for each addition 1 5100.00 or fraction thereof, to and including $2,000.00. $20.00 for the first $2,000. 0 plus $3.00 for each addition 1 thousand or fraction thereof, to and including $25,000.00. $89.00 for the first $25,000.00 plus $2.50 for ea h additional thousand or fraction thereof, to and including $50,000.00. $151.50 for the first $50,000.00 plus $1.50 for ea h additional thousand or fraction thereof, to and including $100,000.00. $226.50 for the first $100,000.00 plus $1.00 for each additional thousand or fraction thereof. Section 303(d). Section 303 of said Uniform Building Code is hereby amended by adding sub-section (d) as follows:. "Where an owner or contractor desires an additional set of approved building plans, the fee for this service shall be $5.00•for residential buildings, and $10.00 for commercial buildings." Section 303(e). Section 303 of said Uniform Building Code is hereby amended by adding sub-section (e) as follows: "After building plans have been ch ecked by the Department of Public Works and if the owner or contractor desire to significantly change or redesign the building or structure which would constitute additional plan checking work, an additional plan check fee may be required." Section 407. In section 407 of the Uniform Building Code delete the definition of "family" and such "family" definition is amended to read as follows: -3- 1 "Family is an individual of two or more persons related 2 by blood or marriage or a group of not more than six persons 3 Cexcluding servants) who need not be related by blood or 4 marriage living together in a dwelling unit." 6 Section 408. In section 408 of the Uniform Building Code g delete the definition of "hotel" and such "hotel':' definition q is amended as follows: 8 "Hotel is any building containing seven or more guest rooms, 9 intended or designed to be used or which are used, rented, or 10 hired out to be occupied, or which are occupied for sleeping 11 purposes by guests." 12 Section 40$. In section 4f~'8 of -=the Uniform Building Code 13 delete the definition of "lodging house" and such "lodging house" 14 definition is amended as follows: 15 "Lodging house is any building or portion thereof, containing 18 not more than six guest rooms ~ihich are used by not more than 17 six guests where rent is paid in money, goods, labor, or ~g otherwise. A lodging house shall comply with all the requirements 19 of this Code for dwellings." 20 Table 5A. Chapter 5, Table 5A, Uniform Building Code, 1964 21 Edition, Groups D-2 and 3 are hereby deleted and such Groups S2 D-2 and 3 are amended to read as above. 23 Section 901. Chapter 9, Section 901, Uniform Building Code, 24 1964 Edition, divisions 2 and 3, are hereby deleted and such 2g divisions 2 and 3 are amended to read as follows: 26 "Division 2 - Nurseries for the full-time care of children 27 under kindergarten age (each accommodating more than six 28 persons). 29 "Hospitals, sanitariums, nursing homes with nonambulatory 30 patients and similar buildings (each accommodating more than 3~. six persons.) 32~ "Division 3 - Nursing homes for ambulatory patients; homes 4- for children of kindergarten age or over beach accomodating more than six persons)." Chapter 70, appendix, Chapter 70 of the appendix of the Uniform Building Code is hereby deleted.
