HomeMy WebLinkAbout1030ORDINADICL~' NO. / O ' C7 2 4 s 6 7 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 AN ORDINANCE OF THE COUNTY OF BUTTIr, STATE OF CALIF- ORrIIA, ZONING: A PORTION OF SAID COUNTY PURSUArIT TO b12DINANCE NOS. 475, 522 and 676 OF SAID COUNTY, AND AMENDING M-1 CONSOLIDATING ORDINANCE NO. 946 The Board of Supervisors of the County of Butte, State cf Calif- ornia, does ordain as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as an "M-1" (Light Industrial) District as hereinafter described and subject to all of the restricted uses applicable to an "M-1" Dis- trict, said area so zoned being located southeast of the City of Chico, particularly described as follows: A portion of Lot 91 as shown on that certain map entitled "Sub divisional Plan of the Durham State Land Settlement ", which map was recorded in the office of the Recorder of the County of Butte, State of California, on February 13, 1919, in Map Book 8 at page 23, and more particularly described as follows: Beginning at a point on the Southwesterly right-of-way line of State Highway 99L, which paint lies 83.00 feet at right angles to Engineer's Station 124+00.00; thence from said point of beginning and running along said Southwesterly right-of-way line, Northc;41°18'45" West 1288.80 feet; thence leaving said line South 48°41'15" West 848.23 feet to a point on the Northeasterly line of Oroville-Chico Road; thence running along said Northeasterly line, on the arc of a 1630 foot radius curve to the right, whose t~a~ng~rit a:t this point bears South 6017' East through a central angle, of 08°53' an axc length of 252.72 feet; thence South 52024' East 766.70 feet to the intersection of said Northeasterly line with the Northerly line of Durham-Oroville Highway; thence running along said Northerly line, North 88 55'45" East 351.20 feet to the beginning of a 460.00 foot radius curve to the left; thence along the arc of said curve through a central angle of 40014'30" an arc length of 323.08 feet; thence North 16036'26" East 80.96 feet to the point of beginning, and containing 20.00 acres more or less. SECTION 2. The following regulations shall apply in an "M-i" (Light Industrial) District: 2.1 Uses permitted: a. Uses permitted in "C-1" and "C-2" Districts. b. Wholesale and storage warehouses. c. The assembly and storage of goods, materials, liquids and equipment (exc@pt the storage of inflammable matter or explosives or materials which create dust, odors or fumes. d. Feed storehouses and warehouses and fuel yards. e. The manufacturing, processing, fabricating, assembling, re- fining, repairing, packaging and treatment of goads, materials and products by power (oil, gas ar electric), including, by way of ex- ample and illustration, but not limited to the manufacturing, fab- rication and assembling of bathroom shower and patio partitions, enclosures and doors, windows and store fronts of aluminum, plastic fiberglass, or other suitable material, and the processing, finish- ing, polishing and anodizing of aluminum extrusions and castings, assaying; broom and brush manufacturing, die casting, dog pounds, draying, freighting or trucking yard ar terminals, heavy equipment 2 4 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26. 27 28 29 30' 31. 32 rental or sale, heating and ventilating service shops, jewelry man- ufacturing, lamp shade manufacturing, lumber yards, packaging plant public utility service yard, truck repairing and overhauling and welding shops. f. Dyeing and rug cleaning plants, veterinary hospitals and animal shelters and boarding kennels, cabinet and woodworking shops construction and material yards. 2.2 Building Site Area Requirements: None, except as may be re- quired for building and for off-street loading area and parking space as set forth below under "Loading Area" and "Parking Space". 2.3 Yaxd Required: a. Front Yards None, except buildings and structures shall be fifty (50) feet from the centerline of the road, except where the road is classified as a Federal Aid Secondary and then the minimum setback shall be fifty-five (55} feet from the centerline of said acad. b. Side Yard: Non®, except where the side of a lot abuts an "R" District, in which case the side yard shall be not less than five (5) feet. c. Rear Yard: None, except where the rear yard abuts an "R" District, in which case the rear yard shall be not less than five (5) feet. 2.4 Truck loading and Unloading Space: Private off-street load- ing space for the handling of all goods, materials and equipment shall be provided. Such space shall b® of sufficient area and of such design as to permit the parking and loading of vehicles with- out extending into any existing street beyond the curb line. 2.5 Parking Spac®: One parking space for. each three (3) employ- ees or one parking space fox each two thousand (2,000) square feet of gross floor space, whichever is greater. 2.6 The fallowing uses subject to the securing of a use permit in each case: a. Any residential dwelling or use. b. Storage of infiammal~les. c. Manufacturing of acids, explosives, fertilizer, glue, gyp- sum, lime, plaster of paris, pulp and paper, beet sugar, crushed rock, sand and gravel, cement, concrete and/or asphalt batching plants, concrete and clay products. d. Industrial uses which might be objectionable by reason of of emission of nois®, offensive odor, smoke, dust, bright light, vibration or involving the handling of explosives or dangerous materials. e, Junk yards and auto wrecking yards. SECTION 3. All uses of land within the district not specifi- cally authorized or permitted under Section 2 are prohibited. SECTION 4. In compliance with the provisions of said Zoning Enabling Ordinance the same is hereby amended by adding to S®ction 5 thereof, this Ordinance in full. SECTION 5. The penalties fox violation of the zoning hereby i posed upon said District shall b® as pravided in said Zoning Enab ing Ordinance. SECTION 6.
