ORDINANCE IQ O. 1035
AN ORDINANCE ZONING A PORTION OF THE COUNTY
OF BUTTE, STATE OF CALIFORNIA, PURAUANT TO
ORDINANCE NOS. 475, 522 and 676 OF SAID COUNTY
The Board of Supervisors of the County of Butte, State of Cali-
fornia, under-and pursuant to Ordinance No. 475 of said County,
..being the Zoning Enabling Ordinance of said County as amended by
'Ordinance Nos. 522 and 676, DO ORDAIN as follows:
SECTION 1. The hereinafter described area sitpate in the County
o.f Butte, State of California, shall be and it is hereby zoned as a
"C-2" (General Commercial) District as hereinafter described and
subject to all of the restricted uses applicable to the uses of a
"C-2" District. Said area being located in the unincorporated area
of Butte County, Oroville, California, particularly described as
follows:-
A portion of the West Half of the West Half of
Section 18, Township 19 North, Range 5 East, and
a portion of the East Half of the East Half of
Section 13, Township 19 North, Range 4 East MDB&M,
described as follows:
Beginning at ..the intersection of the Easterly
prolongation of the Northerly line of the Olive
Highway Extension, as described in Deed to the County
of Butte, recorded October 16, 1957, in Volume 820
of Official Records, at page 321, with the West line
of Orovilie-Wyandotte Fruit Lands Unit No. 5 as per
Map recorded July 20, 1928 in Book 8 of Maps, at
pages 37A and 38A and from which point of beginning
the Northwest corner of Lot 148 of said Unit No. 5
bears North 0° 08' East (described as North 0° 10'
East in Deed to said County of Butte), a distance
of 250.61 feet distant; thence North 76° 59' West
(described as North 77° 11' West in said Deed to
said County of Butte) a distance of 1395.41 feet
along said Olive Highway Extension to the true point
of beginning for this description; thence leaving
said Highway, North 13° O1' East 972.16 feet to a •. ,. _.
point in the South line of Oroville-LaPorte Road;
thence along said LaPorte Road, North- 56° 17'
West 41.08 feet; thence Norti~ 73° 30' West. 87.63 feet;
thence South 78° 15' West 270.35 feet; ..
thence North 71° 15.' West 92.96 feet; thence leaving
said LaPorte Road, South 13' O1' West 878.04 feet
to a point in the said North line of said Olive
Highway Extension; thence along said.Narth line the
follow~.ng 3 courses and distancesa
South 76° 59' East (described as-South 77° 11' East
in Deed to said County of Butte), a distance of
71.69 feet; South 71° 16' .East (described as
South 71° 28' East in said Deed to County of Butte),•
a distance.of..100.50 feet; and South 76° 59' East
(described as~South 77° 11' East in Deed to said
County of Butte}, a distance-of 2.92...19 feet to the
true point of beginning and containing 10.00 acres,
more or less.
SECTION 2. REGULATIONS FOR A "C-2" DISTRICT:
The following regulations shall apply in a °C-2" District:

2.1 USES PERMITTED:
a. Dwellings and dwelling groups, subject to the building sit
area, lot width and yard requirements specified for residential
districts..
b. A11 uses. permitted in C-1 (Light .Commercial) Districts.
c. .General commercial uses including art shops, aviaries; bar
and cocktail lounges, billiard parlors and pool halls, bowling
alleys, building material (retail), cleaning and pressing estab-
lishments, dance:Yialls, interior decorating shops, employment agen-
cies., governmental-legislative buildings, gymnasiums, public, com--
merci.al,or.physical cultural studios, hospitals, hotels and motels,
laboratories- and x-ray facilities, massage parlors and reducing
salons, equipment rentals, pet shops, used car lots, repair
garages, auto. car washes,.. plumbing shops, cabinet shops, sign manu-
facturing-shops, and other retail establishments when interpreted
as similar.
d. AaCessory uses and buildings pertinent to a permitted use.
2.2 LOT WIDTH:REQUIRED: ..
Minimum lot width shall not be less than twenty-five (25)
feet.
The lot width requirements for residential dwellings shall
conform to the requirements for any residential none.
2.3 FRONT YARD REQUIRED:
None, .except buildings and structures shall be fifty (50)
feet from the centerline of the road except where the road is
classified as a Federal Aid Secondary, and then the minimum setback
shall be fifty-five (55) feet from the centerline of .the road.
2.4 SIDE YARD REQUIREMENT:
None, except when the side of a lot abuts upon the side of
a lot in an "R" District, in which case the abutting side yard
shall not be less than five (5) feet; and except where the side.
yard on the street side of a corner lot abuts on an "R" District,
in which case the side yard on the street side shall be one-half
the front yard requirements for any residential zone.
2.5 REAR YARD REQUIRED:
Twelve (12) feet, or five (5) feet adjacent to an alley.
2.6 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT IN
EACH CASE•
a. Welding shops.
b. bianufacturing of clothing, handicraft products, prir~•ing,
lithographing and other light manufacturing or industrial uses of
similar character.
c. Public or quasi-public uses including churches.
d. Service stations, drive-in restaurants, kennels and small.
animal hospitals and mortuaries.
SECTION 3. All uses of land within the District not specifically
authorized and permitted under Section 2 are prohibited.
SECTION 4. Penalties for any violation of the zoning hereby im-
posed within the District shall be as provided in the Zoning Ehabl-
ing Ordinance.
SECTION 5. In compliance with the provisions of said Zoning
Enabling Ordinance, the same is hereby amended by adding to Section
~5 thereof this Ordinance in full.

SECTION 6. This Ordinance shall be and is hereby declared to be
in full force and effect from and after thirty (30) days after the
date of its passage, and before the expiration of fifteen (15) days
after its passage this Ordinance shall be published.: .once with the
names of the members voting for and against it in the Oroville.
Mercury Register, a newspaper published in .the .County of Butte,
State of California.
