HomeMy WebLinkAbout1038ORDINANCE NO. 1038 AN ORDINANCE ZONING A PORTION OF THE COUNTY 1 OF BUTTE, STATE bF CALIFORNIA, PURSUANT TO ORDINANCE NOS. 475, 522 and 676 OF SAID COUNTY 2 The Board of Supervisors of the County of Butte, State of Cali- ' 3 fornia, under and pursuant to Ordinance No. 475, being the Zoning Enabling Ordinance of said County as amended by Ordinance Nos. 522 ~ and 676, DO ORDAIN as follows: s SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as a 8 "A-2 Limited" District as hereinafter described and subject to all of the restricted uses applicable to the uses of an "A-2 Limited" 7 District, said- area so zoned being located in the unincorporated area of Butte County, California, particularly described as follows $ A11 of Block 50, Map of "Thermalito" per wall map. No. 4 '' 9 recorded in the office of the Recorder, County of Butte, State of California; also the south 20 feet of Yuba Avenue LO (abandoned)., the north 40 feet of Yolo Avenue (abandoned) and an unnamed alley 20 feet wide; all located between lI 7th and 8th Streets per map of "Thermalito". Excepting therefrom the southerly 97 feet of the easterly 10"0 feet.. 12 SECTION 2. REGULATIONS FOR AN "A-2 LIMITED" DISTRICT: 13 2.1 The provisions of this classification shall apply to 14 property as described in Section 1. '15 2.2 USES PERMITTED: The following uses are permitted within all parts''of 16 the District: a. Lawful uses of land_now.established. 17 b• Single-family dwellings and accessory buildings.,, c. Agricultural uses and buildings. 18 2.3 USE PERMITS REQUIRED: 19 No multiple-family dwellings, .new commercial buildings, in- dustrial uses of land or buildings, public or quasi-public uses in- 24 eluding schools, churches, public utility buildings will be allowed thout first securing a use permit approved by the Planning Com- !21 mission. 22 2.4 MINIMUM SETBACK REQUIRED: Fifty--(50) feet from the centerline of the road, except here road is classified as a Federal Aid Secondary, then the mini- 23 mum setback shall be fifty-five (55) feet from the centerline of 24 said road. 25 2.5 BUILDING SITE AREA REQUIREMENT: Each single-family residence shall be located on a site not ,2B less than eight-thousand, one hundred and twenty-five (8,125) square feet. `L7 2.6 SIDE YARD REQUIREN~NTS: 28 The minimum side yard .shall not be less than five (5) feet. 29 2.7 REAR YARD REQUIREMENTS: The minimum rear yard shall not be less than five (5) feat. 30 2.8 OFF-STREET PARKING REQUIREMENT: 31 One (1) parking space for each living unit, or one (1} arking space for each three (3} employees, or one (1) parking 32 space for each two thousand (2,000) square feet of gross floor space, whichever is greater. 1 2 3 4 5 6 7 8 9 10. lI i2 13 14 15 16 17 18 19 20 21 22 23 24 2B 26 27 28 29 30 2.9 TRUCK LOADING AND UNLOADING SPACE: Private off-street loading space for the handling of all goods, materials and equipment shall. be provided. Such space shall be of sufficient area and of such desigh as to permit the parking and unloading of vehicles without extending into any existing street beyond-the curb link. 2.10 In cases where compliance with provisions of this section will result in undue hardship, a variance may be approved in said manner prescribed 9.n the tzandling of a use permit., SECTION 3. All uses of land within the District not specifical authorized and permitted under Section 2 are prohibited. SECTION 4. Penalties for any violation of the zoning hereby im- posed within the.District shall be as provided in the Zoning Enab- ling Ordinance, and in compliance with the provisions of the Zoning Enabling Ordinance this Ordinance shall from and after its effee- five date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 5. In compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by adding to Section 5 thereof this Ordinance in full, SECTION 6. This Ordinance shall be and is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fifteen (15) days after its passage this Ordinance shall be published once with the names of the members voting for and against it in the Orovi].le Mercury-Register , a newspaper published in the County of Butte, State of California.
