3 The Board of Supervisors of the County of Butte, State of
4 California, do 'ordain as follows:
S 1. Section 23A-3 of the Code of Butte County, California,
g is hereby amended to read as follows:
7 Section 23A-3. TAX IPriPOSED
g Fair the privilege of occupancy in any hotel,-each
g transient is subject to and shall pay a tax in the
10 amount of five percent of the rent charged by the
Il operator. Such tax constitutes-a debt owed by the
12 transient to the county which is extinguished only by
13 payment to the operator or to the county. The transient
14 sha11 pay the tax to the operator of the hotel at the time
15 the rent is paid. if the rent is paid in installments,
Zg a proportionate share of the tax shall be paid with each
17 installment. The unpaid tax shall be due upon the
~,g transient's ceasing to occupy space in the hotel.
19 If for any reason the tax due is not paid to the
gp operator of the hotel, the tax collector may require
2I that such tax shall be paid directly to the tax collector.
22 This ordinance shall take effect immediately uporL its
23 passage, and before the expiration of fifteen (15) days after its
24 passage, it shall be published at least once with the names of the

25 supervisors voting for and against in a local newspaper published
26 in the County of Butte, State of California.
