HomeMy WebLinkAbout1049 4; 5' 6 7 8' 9 10 11 12 13 14 15 16 1'7 18 19 2d 2I. 22 23 24 23- 26 27 28. 29 30. 31 32 ORDINANCE N0. 101+9 AN INTERIM ORDINANCE OF TIME COUNTY OF BUTTE, STATE OF CALIFORNIA, ZONING A PORTION OF SAID COUNTY PURSUANT TO ORDINANCES NOS. 475, 522 A(VD 676, OF SAID COUNTY, AMENDING ORDINANCE 912 "A-R" (AGRI- CULTURAL RESIDENTIAL), AND DECLARING AN EMERGENCY The Board of Sups-visors of the County of Butte, State oaf California, under and pursuant to Ordinance No. 475, being the Zoning Enabling Ordinance of said County as amended by Ordinance Nos. 522 and 676, DO ORDAIN AS FOLLOWS: SECTION ]. NECESSITY: The Board of Supervisors finds that certain regulations are necessary for the preservation of the public health, safety, conservation and general welfare, pending the studies and surveys and the preparation and adoption of a pre-. vise zoning plan for the area. SECTION 2. The hereinafter described area situate in the County of Butte, State of California, shall be and it is here- by zoned as an "A-2 Limited" District as hereinafter described and subject to all of the restricted uses applicable to the uses of an "A-2 Limited° District, said area so zoned being located in the unincorporated area of Butte County, California, particular- ly described as follows: Lots 135, 136, 137, l38 and 139, all as shown en Map of "Olive-Glen Estates Revised" per map recorded in Map Book 35 on pages 8, 9 and 10, in the office of the Recorder, County of Butte, State of California; & AP 34-16-08, 9.14 Acres,- as of record in the Assessor's Office March 1, 1969: SECTION 3. REGULATIONS: 3.1 The provisions of this Ordinance shall apply to all property as described in Section 2. 3.2 USES PERMITTED: The following uses are permitted within all parts of the District: a. Lawful uses of land now established. b. Single-family dwellings and accessory buildings. c. Agricultural uses and buildings. 1 3.3 USE PERMITS REQUIRED: 2 No multiple-family dwellings, new commercial buildings, 3 industrial uses of land or buildings, public or quasi-public uses 4 including schools, .churches, public utility buildings, will be b allowed without first securing a use permit approved by the Plan- e Wing Commission. 7 3.4 MINIMUM SETBACK REQUIRED: 8 Fifty {50) feet from the centerline of the road, except 9 where the-road is classified as a Federal Aid Secondary and then ~0 the minimum setback shall be fifty-five (5.5) feet from the center- I1 line of said road. 12 3.5 BUILDING SITE AREA REQUIREMENTS: 13 Each single-family residence shall be located on a site 14 'not less than eight-thousand, ane hundred and twenty-five (8,125) ~~ 15 .square feet. 16 3.6 SIDE YARD REQUIREMENT: 17 The minimum side yard, shall not be less than five (5) 18 feet. 19 3.7 REAR YARD REQUIREMENT: 20 The. minimum rear yard shall not be Less than five (5) 2I feet. 22 3.8 OFF-STREET PARKING REQUIREMENT: 23 One (7) parking space for each living unit, or one park- 2~ ing space for each three (3) employees, or one (1,) parking space 2S for each two thousand (2,000) square feet of gross floor space, 26 whichever is greater. 27 3.9 TRUCK LOADING AND UNLOADING SPACE: 28 Private off-street loading space for the handling of all 29 .goods, materials and equipment shall be provided. Such space shall 30 be of sufficient area and of .such design as to permit the parking 31 and loading of vehicles without extending into any existing street 32 beyond the curb line. -2- i 2~ 3 !4 5 6 7 '8 9 10 'll 12. 13 14 15 16 17 18 19 20 irl 22 23 24 2B 26 27 28 29 30 31 32 3.10 In cases where compliance with provisions of this section will result in undue hardship, a variance may be approved in said manner prescribed in the handling of a use permit. Sf CTION 4. Far the immediate preservation of the public peace, health and safety of the area hereinabove described, and the residents and inhabitants thereof, it is necessary that this Ordinance take effect immediately. A declaration of the facts constituting the necessity therefor is as follpws: The adoption of such interim zoning plan is necessary in the public interest, to maintain the status quo in such district, pending the determination of permanent detail zoning. SECTION 5. This emergency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15) days after its passage shall be published once with the names of ali members of the Board of Supervisors voting for and against the same in the Oroville Mercury Register, a newspaper published in said County of Butte, State of Ealifornia.
