HomeMy WebLinkAbout1068~! _ __ _.__ ~° ORDINANCE NO. ,,.•.~$~.~~ ~~}~5_ AN ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, ZONING A PORTION OF SAID COUNTY PURSUANT TO ORDINANCE NO. 475, AS AMENDED l The Board of Supervisors of the County of Butte, State 2 of California, under and pursuant to Ordinance No. 475 of said 3 County, being. the Zoning Enabling Ordinance as amended DOES ORDAIN 4 as follows: 5 SECTION 1. The hereinafter described area situate in 6 the County of Butte, S"fate of California, shall be and it is 7 hereby zoned as an "S-2" (Suburban-Residential) District and such S area shall be subject to the restrictions and restricted uses and 9 regulations. hereinafter specified and provided. Said area so 10 zoned being located in Paradise, an unincorporated area of Butte 17. County, California, and particularly described as follows: !12 All that portion of the North half of the Northwest quarter of the Southeast quarter and the Southwest 13 quarter of the Northwest quarter-of Section 26, T22N R3E MDB&M, lying West of ",Clark Road". 114 Excepting the Northerly 331.23 feet thereof. 15 Als,o_excepting therefrom all that portion located '16 within 300 feet of the West right of way line of "Clark Road". 17 All of the Southeast quarter of the Northeast quarter X18 of Section 27, T22N R3E MpB&M, (._ lg Excepting therefrom that portion of said description lying North and West of the following described 20" line; commencing at the Northeast corner of the Southeast quarter of the Northeast quarter of 2.1 Section 27, T22N R3E MOB&M, thence West, 834.14 feet; thence South, 250 feet; thence South 22 39°16'04" West, 165..7 feet; thence South 22°09'42" West, 233.11 feet; thence West, 84.43 feet, thence 23 South, l60 feet; thence West 221.61 feet. "2!t SECTION 2. Regu7.ations for an "S-2" District. The 25 following regulations shall apply in an "S-2" District: 2'6 2.1 USES PERMITTED: 27 a. Single-family dwellings, not including tents or 28 Mobile Homes. 29 b. For each horse or head of cattle over one year of age, eight thousand one hundred twenty-five. (8, 125) square feet. b. For each head of swine over ten (10) weeks of age, :eight thousand one hundred twenty°five (8,125) square feet. c. For each head of sheep or goats, two thousand (2,000) square feet. 2.3 LOT AREA: Minimum required area of a lot per dwelling unit shall be not less than one (1) acre. 2.4 LOT WIDTH: Minimum lot width shall be not less than one hundred thirty E130) feet. 2.5 FRONT YARD: Minimum front yard shall be fifty (50) feet from the centerline of the road except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback requirement shall be fifty- five (55) feet from the centerline of said road. 2.6 SIDE YARD: Minimum side yard shall be not less than ten (10) feet. SECTION 3. The following uses subject to securing a CJse Permit in each case: a. Public and quasi-public uses, including churches. b. Hospitals, parks and playgrounds, schools and public utility buildings. SECTION 4. Ali uses of land within the district not specifically authorized and permitted in Sections 2 and 3 are prohibited. SECTION 5. In compliance with the provisions of said Zoning Enabling Ordinance, the same is hereby amended by adding to Section 5 thereof this Ordinance in full. SECTION 6. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance -2- ~~ . l; 1 shall from and after its effective date become a supplement to 2 and part of the Zoning Enabling Ordinance. ,3 SECTION 7. This Ordinance shall be and it is hereby g declared to be in full force and effect from and after thirty (30) days after the date of its passage; and before the expiration of g fifteen (I5) days after its passage this Ordinance shall be 7 published once with the names of the members of the Board voting g for and against it in the Paradise Post, a newspaper published !g in the County of Butte, State of California. 10 PASSED AND ADOPTED by the Board of Supervisors of the 11 County of Butte, State of California, this 24th day of 12 January 19`J~, by the following vote: 13 Supervisors Howsden~ Maxon~MeKillop= Reyxiolds; Chairman 14 AYES:Dunaway 15 NOES: One 16 ABSENT : ~to17e `/'~ 17 NOT VOTING: None ~ .--- O.
