`~ ORDINANCE N0. 1089
AN ORDINANCE ADOPTING SUBDIVISION REGULATIONS
FOR THE UNINCORPORATED AREA WITHIN THE COUNTY
OF BUTTE AND AMENDING BUTTE COUNTY CODE SECTIONS
The Board of Supervisors of the County of Butte, State
of California, do hereby declare anal ordain as follows:
Section 20-2 of the Butte County Code is hereby amended
to read as follows:
"20-2. ALTERATIONS OF SUBDIVISIONS
Ao No subdivision shall be altered in whole or in any
substantial part as to general plan, lot size or
boundaries after its final approval, nor shall any
single lot in a subdivision, after its final
approval, be separated in ownership or reduced in
size below the minimum lot dimensions or lot area
required by this ordinance, without the prior
approval of the Planning Commission.
B. Revisions not requiring a new subdivision map may
be made by the submission of a plat.
C. This section skzall apply to all subdivisions
finally approved on or after July 1, 1949; provided,
however, that it shall not apply to any separation
in ownership or reduction in size of any individual
lot occurring prior to the effective date of this
section."
Section 20-4.4 of the Butte County Code is hereby
amended to read as follows:
"20-4,4. LOT
A parcel of land used or capable of being used under the
provisions hereof, including both building site and the
required yards and other open space as.defined herein,
and having the required road or street frontage.
Flag lots are undesirable but they may be approved by the
Planning Commission under unusual circumstances."

Section 20-15 of the Butte County Code is hereby amended
to read as follows:
"20-15. FORM OF FINAL MAP
A. The final subdivision map shall be clearly, legibly,
and accurately drawn in black, waterproof India ink
upon good tracing cloth or with acetate ink on a
stable base polyester film such as chronar or mylar
base films, or equivalent materialo Signatures
shall be in opaque black intro Affidavits, cert-
ificates, and acknowledgements may be legibly stamped
or printed upon the map with opaque ink. The map
shall be so made and in such condition when filed
that good, legible and clear prints can be made
therefromo The ink surface on polyester film shall
be coated with a suitable substance to assure perm-
anent legibility,
S. The size of the sheets shall be eighteen by twenty-
six inches (18" x 26"). A marginal line one inch (1")
from each edge of the sheet shall be drawn completely
around each map sheeto A11 information on each sheet
of the final map shall be within this marginal line.
', Each sheet shall be numbered, the relation of one sheet
to the other clearly shown, and the number of sheets
used shall be set forth on each sheet. A small key
map on each sheet shall clearly show the relation of
that portion of the subdivision to the entire sub-
division. The desirable scale of the final map shall
be large enough to show all details clearly and enough
sheets shall be used to accomplish this end. The
desirable minimum scale is 1" = 100'.
C. The exterior boundary of the land included within the
subdivision shall be indicated by a colored border in

1 transparent ink applied to the reverse side of the
2 tracing. The ink should preferably be blue and shall
3. not obliterate figures or other data.
,~~ D. The map shall be drawn so that with the 18" dimension
6 placed in the vertical position, it can be easily
g read from left to right and the title block will
7 appear in the lower right-hand corner."
g Section 20-30.1 of the Butte County Code is hereby amended
g to read as follows:
10 "20-30.1. STREETS AND HzGHWAXS
13. 1. Relation to Topography: Topographic condition shall
12 determine the general pattern of subdivision design, and
13 shall control the placement and alignment of roads within
14 the subdivision.
15 2. Split Level Roads: Split level roads will be per-
16 mitred in hillside and mountain subdivisions. The design
17 of such roads shall be approved by the Department of Public
'lg Works prior to construction.
'lg 3. Relation to Adjacent Streets: The arrangement of
20 roads shall provide for the direct continuation of the
21 centerlines of the existing roads in adjacent or adjoining
22 areas.
2g 4. Road Names: Roads which are extensions of, or are
2g determined to be in future alignment with, existing named
25 roads shall bear the name of the existing road. Naming of
gg new subdivision roads shall be subject to the approval of
27 the Planning Commission and shall not duplicate or be
2g similar to any other road in the County.
29 5. Road Rights of Way:
30 (a) Dedicated Rights of Way. Where rights of way are to
3~, be dedicated to the County, they shall be improved to the
32 appropriate standards but said rights of way must be

1 connected to an existing county maintained street or
2 highway.
3 (b) Primary Highways. Primary highways as designated
4 by the State of California or the County of Sutte shall
~ have a minimum width of 84 feet regardless of location or
g topography within the County.
7 (c) Major and Local Access. Major and local access
8 roads as defined in the subdivision ordinance shall have
9 a minimum width of GO feet for all classes of subdivisions,
10 (d) Minor Roads. Minor roads, one-way loop roads,
11 cul-de-sac roads, and frontage roads shall have a minimum
12 width of 50 feet for all classes of subdivisions,
13 (e) Split Level. Split level and sidehill residential
14 roads shall have a minimum of 50 foot right of way width
15 or a 60 foot right of way width, depending upon their
16 further classification as a local access road or a minor
17 road.
18 (f) Hardship Cases. In exceptional cases where the
19 developer subdivider shows extreme hardship and where the
2p right of way width is not required for public utilities or
21 cut or fill slopes, the Planning Commission may authorize
22 a reduction in the right of way widths given above.
23 (g) Fxisting~ County Roadso Where existing County rights
24 of way are less than thirty (30) feet from each side of
2S centerline, and are included within a subdivision or are
26 on the boundary of a subdivision, a dedication shall be
2'7 made on the final map to insure such. width to a minimum of
28 thirty (30) feet on each. side of the centerline on which
29 the subdivision is being developed. Where the subdivision
30 borders on a Federal Aid Secondary road or major roads
33. designed on the Master Plan, additional right of way shall
32 be dedicated as determined by the Director of Public Works.

1 Ch) Cul-de-sac. Right of way for cul-de-sac turnaround
2 shall be fifty (50) feet radius.
3 (i) Unimproved Dedication of Right of Way. Where a
~} road dedication of one lot depth is required through lots
~ to a future development, the subdivider will not be required
g to improve the roadway beyond the radius return if the ded-
q ication is of no immediate benefit to the subdivider and
g no lot will face said dedicated easement.
~ g (j) Where cuts or fills extend beyond the normal right
10 of way width, the right of way shall be increased to allow
11 a minimum of three (3) feet outside the normal 12:1 fill
12 or embankment,
13 6. Road Grades: Road grades shall be in accordance
14 with the resolution adopted by the Board of Supervisors
15 and future additions, amendments, or reservations to that
16 resolutiono
17 7. Curves•
18 (a) Primary Roads. Primary roads and major roads shall
19 be designed in accordance with a design speed which will
20 be established by the Director of Public Works, except in
21 hilly or mountainous areas, a minimum radius of three
22 hundred (-300} feet may be accepted upon recommendation of
23 the Department of Public Works,
24 (b) All Others. A minimum of one hundred (100) feet,
25 except in unusual topographic conditions, the Director
26 of Public Works may accept a lesser radius.
27 ~. Intersections; The intersection of streets shall
28 be at an angle of 90° except that in unusual conditions
29 of topography, the Director of Public Works may accept an
30 intersection at a lesser angle. Two streets intersecting
33. with the same street shall intersect with centerlines
32 directly opposite each other or at a distance of not less

than two hundred (200) feet between centerlineso
9. Radius Returns: Curb lines at street inter-
sections shall be rounded at the road corners to a
radius of thirty (30) feet.
10. Reserve Strips: One-foot parcels, or reserve
strips, controlling access to existing streets or high
ways or to adjacent properties where future streets may
connect shall be deeded to the County of Butte upon
request of the Department of Public Works. ReseL~re
strips shall not be reserved by the owners of the
subdivision.
11. Public Utility Easements: Twelve (12) foot
public utility easement shall be dedicated to the County
of Butte, along the back of lots, and/or side lines of
lots where necessary to allow circulation of public
utilities throughout the subdivision if required by public
utility agencies.
12. Sewer Easements: Twelve (12) foot sewer easements
shall be dedicated as requested by the Director of Public
Works. Easements of greater width may be required for
dedication to the County of Butte,
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California, this 5th day of May
1970, by the following vote:
