HomeMy WebLinkAbout1093ORDINANCE NO. 1093 1 2 3 4, 5 6 7 8 9 ZO 11 12 13 14 15 16 17 18 19 20 21 22 ' 23 24 2S 26 27 28 29 30 31 32 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, PURSUANT TO ORDINANCE ' NO. 475, AS AMENDED, OF SAID COUNTY. PURPOSE OF CLASSIFICATION. The Board of Supervisors finds and determines that: 1. The Mobile Home, as a residence, is an accepted :mode of living which offers certain advantages and attractions to`seg- ments of the public. 2. The development and operation of Mobile home Parks, as related to adjacent areas, deserve special consideration.;; Therefore, the purpose of this Ordinance is to permit areas for Mobile Home Parks in pleasant, residential surroundings, properly integrated with adjacent neighborhoods, to the optimum benefit of residents of the Mobile Home Park and of the greater community. The Board of Supervisors of the County of Butte, State of California, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance of said County, as amended, DOES ORDAIN as follows: SECTION 1. Thehereinbelow described area, situate in the County of Butte, State of California, shall be and is hereby zoned as a MHP (Mobile Home Park) District and such area shall be subject. to the restrictions and restricted uses and regulations hereinafter specified and provided, said area so zoned being. located in the unincorporated area of Butte County, California, and particularly described as follows: A portion of Lots 28 and 29, as shown on that certain map entitled "Map of 0afcdale Farms Sub- division No. 2; which map was recorded in the Office of the Recorder of the County of Butte, ,. State of California, April 24, 1924, in Book 9 of Niaps, at page 33, and described as follows: ~' Commencing at the Northeast corner of Lot 30, as shown on said Map, said point being located in the centerline of the Sutter Road Reservation; thence South 89°11' West along the centerline of the Sutter Road, being along the Northerly line of said Lots 30 and 29, a distance of 324.11 feet; thence South 0°31' West, a distance of 35,1.78 feet to the true point of beginning of the'land h~prein described; thence from said true point of beginning, South 0°31' west, a distance i~~3 II 1 2 3 4 5• 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 2~4 23 26 27 28 29 30 31 32 of 351.78 feet to the Southerly line of said Lot 29; thence South 89°54' West along the Southerly line of said Lot 29 and 28, a distance of 310.56 feet; thence North 0°31' East, a distance of 349.83 feet to a point which is South 0°31' West, a distance of 349.84 feet from the Northerly line of said Lot 28; thence -North 89°54' East and parallel with the Souther- ly line of said Lots 28 and 29, a distance of 310.56-feet to the true point 'of beginning. Containing 2.62 acres, M/L. Commencing at the center of Section 28, To-unship 22 North, Range 3 East, MDB&M; thence North 1°05'08" East, along the West line of the North- east quarter of said Section 28, a distance of 176.00 feet to a compromise corner as contained in Agreement between J. W. Brown, J. F{. Cook and C. R. Stearns, dated June 2, 1913 and re- corded November 28, 1913, in Book J of Covenants at page 428; thence South 88°58' East along said compromise line 245.82 feet to the point of beginning; thence continuing South 88°58' East along said compromise line a distance of 665.98 feet to the Northeast corner of Lot 3, of the J. W. Brown Tract, the official map of which subdivision is on file in the Office of the Recorder of Butte County, California; thence South along the East line of said Lot 3, a dis- tance of 506.00 feet; thence North 88°58' West, 911.8 feet to the North and South centerline of said Section 28; thence continuing West 1315.00 feet, more or less, to the center line of the Neal Road; thence Northeasterly along the center line of said Neal Road to the East and West center line of said Section 28, thence East along said East and West center line of said Section 28 to a point which bears North 88°58' West and 232.2,7 feet distant from the center of said Section 28, thence from said point South O1°05'08" West, a distance,: of 165 feet; thence South 88°58' East a distance of 264 feet; thence North O1°05'08" East, a distance of 165 feet to the East West centerline of said Section 28; thence Easterly along said East West center- line a distance of 214.09 feet;, thence North Ol°05'08" East, a distance of 176.6 to the paint of beginning. Containing 19.38 acres, M/L. SECTION 2. APPLICATION OF' REGULATIONS. The regulations of this Ordinance shall apply in all Mobile EIome Park Districts. USES PERMITTED: The following uses subject to securing an approval'by the Planning Department of a Master Development Plan: a. Principal uses: 1. Accessory uses: Subject to appropriate conditions, the following accessory uses may be approved, as a part of the Mas er Development Plan, in any Mobile Home Park: 1. Management office and maintenance equipment storage. 2. Coin operated laundry and dry cleaning facilitieSr for residents only. 3. Vending machines, for residents only. 4. Non-commercial recreation, meeting, halls, clubhouse, swimming pools, etc. 5. Storage facilities, for residents only. 6. Chapel. 7. Car washing facilities, for residents only. 8. Other uses which are clearly incidental and subordinate to the principal use. 2.2 STANDARDS FOR MOBILE HOMES AND ACCESSORX USES. a. Minimum site area: 10 contiguous acres. b. Maximum density: The density, determined by the Master Development Plan approval, shall not exceed the following: Ten Mobile Homes of 750 square feet or less in gross area; eight': Mobile Homes of more than 750 square feet in gross area per acre; or a combination thereof. c. Prior to occupancy of the first Mobile Home, not less than 50 Mobile Home lots shall be prepared and available for`.. occupancy. d. Parking requirements: The overall parking ratio shall Abe two Barking spaces (10' x 20`) per Mobile dome lot. At least one parking space shall be provided on or immediately adjacent to each Mobile Home lot. 3. Building lines: All structures and Mobile Homes shall have a setback of at least 25 feet from all property lines and any street or road right of way adjoining the Mobile Home Park. The setback area shall be landscaped and maintained as a buffer ~3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 I 15' 16 17 18 19 20 21 22 23 24 25 28 27 28 29 30 31 32 strip, and in all cases the setback area shall be in conformity with Butte County Code - Chapter 10, Article ZI. f. Signs: Each Mobile Home Park shall have a bulletin for the listing of each Mobile Home site and the name of the occupant thereof. The bulletin board shall be located outside the office and shall be lighted at night. Adequate signs and marking indicating directions, parking areas, recreation areas and street names shall be estab- lished and maintained in the Mobile Home Park. Such signs shall not exceed six (6) square feet in area. Signs, or name plates not exceeding two (2) square feet in area and displaying the name and address only of the occupant of the Mobile Home may be erected at each Mobile Home site. Signs which identify or advertise the Mobile Home Park may be erected if approved by the Planning Department in its action on the Master Development Plan for the Mobile Home Park. Such signs must be located on the premises and shall be not more than one hundred twenty (120) square feet in area. They shall not be animated or illuminated except by indirect non--flashing light.' g. Utilities: All utilities shall be installed underground. 2.3 PROPERTY DEVELOPMENT STANDARDS. ', The following development standards shall apply to the ;individual Mobile Home sites. Plans and elevations for the Mobile Home Park shall be submitted along with other construction plans with the Master Development Plan for a Mobile Home Park, and shall be subject to review and change upon recommendation of the Planning Department. MOBILE HOME SITE AREA.- The Mobile Home sites in a Mobile Home Park shall average 3000 feet in area, but no site shall'be smaller than 2700 square feet. MOBILE HOME SITE WIDTH. Each Mobile Home site designed far a single Mobile Home shall be of an average width of 42 feet. -4- 1 2 3 4I 5 BI 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2S 26 27 28 29 30 31 32 Sites designed fora double width or larger shall be of an average width of 30 feet plus the width of the Mobile Home, unless it can be shown that adequate space for a patio, parking, and side yards will be assured, despite a site of less width. MOBILE HOME SITE FRONTAGE. Each Mobile Home site shall abut directly upon a Mobile Home Park street for a minimum distance of thirty (30) feet. POPULATION DENSITY. Not more than one single-family Mobile Home may be placed on a Mobile Home site. LANDSCAPING. The followinq landscaping provisions shall apply in all Mobile Home Parks: a. All open spaces except driveways, parking areas, walkways, utility areas, improved decks, patios, or parches shall be maintained with landscaping. 2.4 SPECIAL DEVELOPMENT STANDARDS. a. Walls and fences: Walls and fences on individual Mobile Home sites shall not exceed two (2) feet in height. Walls or fences snail be erected around the perimeter of each Mobile Home Park as may be required by the Planning Department. The height, construction and type of material for such perimeter walls or fences shall be as specified by the Planning~Department,. b. Mobile Home Park streets: Mobile Home Park streets shall be provided in such a pattern as to provide convenient traffic circulation within the Mobile Home Park. They shall be constructed to the following standards: 1. A11 Mobile Home Park streets shall have a width of not less than 30 feet including curbs. 2. There shall be concrete rolled curbs on each side; of the streets. 3. The Mobile Home Park streets shall be paved in conformity to Butte County standards. 4. Drainage facilities and encroachment to public roads shall be in conformity with the Butte County Depart- ment of Public works standards. 2,5 RECREATION AREAS. A central recreation area shall be established in each Mobile xome Park created pursuant to the provisions of this. article.. The size of such area shall be at least two hundred (200) square feet per Mobile Home site. The recreation area may contain community clubhouses, swimming pools, shuffleboard courts and similar facilities. The Planning Depart- ment may permit decentralizaticn of the recreational facilities in accordance with principles of good planning provided that.;the total recreation area meets the above stated minimum size. 2.6 MOBILE HOME PARK OFFICE. Every Mobile Home Park shall include a permanent building for office use. Such building may include a single-family dwelling fox the exclusive use of the owner or manager. 2,7 LAUNDRY ROOMS, Every Mobile Home Park ,shall have' one or more laundry zooms. Laundry drying lines shall not be` permitted on any Mobile Home site. 2.8 MAIL BOXES PROVIDED. Each Mobile Home site shall. be equipped with a recep.table for mail deliveries in accordance with acceptable standards of the United States Post Office Department. 2.9 TELEPHONES. The-Mobile Home Park shall contain at least one (1) public telephone for the use of park residents. 2.10 STORAGE AREAS. Areas used far storage of travel railers, boats and other such items, may be established in a Mobile Home Park. provided they are adequately screened from public view. 2.11 UTILITIES. All utility distribution facilities, including television antenna service lines serving individual: Mobile Home sites shall be placed underground. The owner is` -6- ii' l 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 responsible for complying with the requirements of this section and he shall make the necessary arrangements with each of the! serving utilities for the installation of such facilities. Transformers, terminal boxes, meter cabinets, pedestals, concealed ducts, and other facilities necessary appurtenant to such under- ground facilities shall be installed in conformance with specifica- tions of the State of California Department of Housing and Community Development - Division of Building and Housing Standards. 2.12 COMMUNITX TELEVISION ANTENNA. Individual rooftop ar outdoor television antennas shall not be permitted in a Mobile Home Park. One single television antenna for community service -: may be situated within the Mobile Home Park. 2.13 DOGS AND ANIMALS. Dogs and other household pets. shall not be permitted to run at large in any Mobile Home Fark'. Bird aviaries, poultry and other barnyard animals shall not be permitted in any Mobile Home Park. 2.14 TRANSIENT SPACES. Not more than ten (10) per cent of the Mobile Home sites may be used for transient Mobile Home sites. Sites reserved for transient Mobile Homes shall be so designated on the plans submitted with the Master Development Plan. 21 The site, yard and property development standards of this classi- 22 fication shall fully apply to sites reserved for transient Mobile 23 Homes. Mobile Homes which are smaller than specified in Section 24 2 may occupy such designated transient Mobile Home site for a 23 period of up to ninety (90) days. 26 SECTION 3. All uses within the District not specifically 27 authorized and permitted in Section 2 are prohibited. 28 SECTION 4. In compliance with the provisions of said 29 Zoning Enabling Ordinance, the same is hereby amended by adding 30 this Ordinance in full. 31 SECTION 5. The penalties for violation of the zoning. 32 hereby imposed within the District shall be as provided in the -7- E ~~I 1 Zoning Enabling Ordinance. In compliance with the Zoning Enabling 2 Ordinance,- this Ordinance shall from and after its effective date 3 become a supplement to and part of the Zoning Enabling Ordinance. 4 SECTION 6. This ordinance shall be and is hereby declared 6 to be in full force from and after thirty (30) days after the 6 date of passage; and before the expiration of fifteen (15) days 7 after its passage, this Ordinance shall be published once with. 8 the names of the. members of the Board of Supervisors voting for 9 and against it in the.
