RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
RE-ESTABLISHING THE COURTHOUSE CONSTRUCTION FUND
WHEREAS, on December 19, 1989, the Board of Supervisors established a trust fund for
courthouse construction for the purpose of assisting in the establishment of adequate courtroom facilities;
and
WHEREAS, the trust was funded by certain assessments upon specified fines, penalties, and
forfeitures; and
WHEREAS, subsequently, on October 31, 1991, the Board of Supervisors established the
Criminal Justice Facility Construction Fund for the purpose of assisting in the establishment of adequate
criminal justice facilities; and
WHEREAS, because these two funds serve two very similar functions, and the Criminal Justice
Facility Construction Fund has more flexibility and is more adaptable to County means, on June 10, 2003,
the Board of Supervisors approved Resolution 03-090, which rescinded the Courthouse Construction Fund,
and directed a!1 proceeds into the Criminal Justice Facility Construction Fund; and
WHEREAS, staff has become aware that some court fines are still required to be deposited into
the Courthouse Construction Fund; and
WHEREAS, in order to maintain compliance with Vehicle Code 42007 and Government Codes
76000 and 76100, staff recommends re-establishing the Courthouse Construction Fund.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Butte
approve Resolution re-establishing the Courthouse Construction Fund, and direct only those proceeds that
are required to go into the Courthouse Construction Fund to be deposited in the fund and all other
distributions remain as is.

2011 by the following vote:
