HomeMy WebLinkAbout1104ORDINANCE NO. 3.1.Ok-I- AN INTERIM ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "A-R" (AGRICULTURAL- RESIDENTIAL) DISTRICT, AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS. l 2 ~ The Board of Supervisors of the County of Butte, State of 3 California, under and pursuant to Ordinance No. 475, as amended, 4 and declaring an emergency DOES ORDAIN as follows: $ SECTION 1. The hereinafter described area situate in the g!County of Butte, State of California, shall be and it is hereby q zoned as an "A-R" (Agricultural-Residential) District and such. g area shall be subject to the restrictions and restricted uses and g regulations hereinafter specified and provided. Said area so lp zoned being located in the unincorporated area of Butte County, and 11 more particularly described as follows: 12; The Northeast quarter of Section 24, T22N R3E, MDB&M, Earadise, California. 13 SECTION 2. REGULATIONS FOR AN "A-R" DISTRICT: l4 The following regulations shall apply in an "A-R" District: 15 2.l USES PERMITTED: 16 a. Single-family dwelling, not including tents or 17 trailers. 18 b. Accessory buildings pertinent to the permitted uses. 19: c.~ Agricultural uses. 20 d. Livestock, subject to requirements as follows: 2I 1) Minimum iot area to be devoted to residential use 22 shall be not less than eight thousand one hundred twenty-five 23 '.(8,125) square feet. 24 '! - 2) Exclusive of the area devoted to the residential use, 25 the following lot or parcel area shall be required for each animal 26 raised or kept on the premises: 27 a) For each horse or head of cattle over one (l} year 28 of age--eight thousand one hundred twenty-five (8,125) square feet. 29. b) For each head of swine over ten (10) weeks of age-- 30 ~' eight thousand one hundred ta,:enty-five (8,125) square feet. 31 c) For each head of sheep or goats--two thousand 32 (2,000) square feet. 1 2 3 4 5 6 7 8 9 10 Il 12 13 l~ 15 16 17 18 19 20 21 22 23 24: 25 26 2'7 28 29 30 31 32 2.2 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT TN EACH CASE: a. Duplex dwellings and multiple-family dwellings. b. Golf courses, country clubs, if permitted, would per- mit accessory uses such as driving range, pro shop, cocktail bar, res taurant. c. Public and quasi-public uses including churches, fire houses, hospitals, parks and playgrounds, schools and public utilit .buildings. d. Commercial poultry farming and livestock farming. e. Veterinary clinics, outpatient. f. Nurseries and plant gardens. 23 LOT AREA REQUTRED: Minimum required area of a lot per dwelling unit shall be not less than eight thousand one hundred twenty-five (8,125) square feet. 2.4 LOT WIDTH REQUTRED: Minimum lot width shall not be less than sixty-five (65) feet. 2.5 FRONT YARD REQUIRED: Minimum front yard shall be fifty (50) feet from the center line of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the minimum building setback re- quirement shall be fifty-five {55) feet from the centerline or road 2.6 SIDE YARD REQUTRE1~lENT: Minimum side yard shall not be less than five {5) feet. SECTION 3. In compliance with the provisions of said .Zoning Enabling. Ordinance, the same is hereby amended by adding this Ordinance in full. SECTION 4. The penalties for the violation of the zoning hereby imposed within the district shall be as provided in the Zoning Enabling Ordinance. SECTION 5. This emergency ordinance shall take effect immediately upon its passage, and before the expiration of fifteen (15} days after its passage shall be published once with the names of ali members voting for and against the same in the PARADISE pp~~ a newspaper in general circulation in !the County of Butte, State of California.
