HomeMy WebLinkAbout1108ORDINANCE N0. 13.08 1 2' 3 4 5 6 7, 8: 9' 10 I1 12! 13 14- 15' 16_ 17i 18 19 20 21 22 23 24 25 26 2'7 28' 29 ~I 30 31 32' AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "R-1 A&C" (MINIMUM-DENSITY SINGLE-FAMILY DWELLING, ARTS & GRAFTS AND PROFESSIONAL} DISTRICT, AND ESTABLISHING REGULATIONS FOR THE USE OF LAND AND THE CONSTRUCTION OF BUILDINGS. The Board of Supervisors of the County of Butte,.State of California, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance, as amended, DOES ORDAIN as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and it is hereby zoned as an "R-1 A&C" (Minimum-Density Single-Family Dwellings, Arts & Crafts and Professional) District, and such area shall be subject to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, Beginning at the center of Section 10, T22N R3E MDB&M; thence North 54"43' east along the Paradise Irrigation District boundary to the section line common to Sections to & 11, T22N R3E MDB&M; thence south along said common line 130 feet m/1 to the northwest corner of a parcel recorded 1537 ON 330, in the Office of the Recorder, County of Butte, State of California; thence easterly along said parcel 209 feet, to the northeast corner of said parcel, thence southerly 318 feet, thence N85"16'50"E, 435 feet; thence north 123.85 feet; thence N6/"22'E, 225.35 feet; thence N81"33'E, 430.28 feet; thence N55"05'E, 354.55 feet; thence N75°55'E, 47T.37 feet; thence N50"48'E, 157.50 feet; thence N27"11'E, a distance of 175 feet m/1 to a point, said point being the intersection of the northerly prolongation of"Paragalia Way" centerline; thence southerly along said centerline to the East-West centerline of Section ll, T22N R3E, MDB&P1; thence westerly along the East-West centerline of Section 11 & Section 10 to the center of Section lU, being the point of beginning. SECTION 2. The following regulations shall apply in an "R-1 A&C" District: 2.1 USES PERMITTED: a. Single-family dwellings, not including tents or trailers. b. Accessary buildings pertinent to the permitted uses. c. The following uses are considered to be accessory uses and are permitted in an "F.-1 A&C" zone only 1 when conducted on the premises with a residence 2 occupied and used as a residence by the proprietor 3 of such use, and no display or display window g' visible from a street shall be permitted: ~ 1. Domestic arts and crafts, including, but not g limited to the fallowing: q a. ceramics, g b. needlework, g , c. dressma]King, 10 d. art studio, including photography, I1 e. lapidarist, and 12 2. Professional services shall conform to the following 13 conditions: 14 a. Not mare than one (1) employee or assistant is en- 1g gaged for work or service on the premises in 16 connection with such uses. 17 b. One (1) single--faced, unlighted sign shall not 18 exceed three (3) square feet in area, used ex- 19 elusively to advertise products made, services 20 rendered or business conducted on the premises, 21 and such signs shall not be located in any re- 22 quired yard. 83 c. Not to exceed two (2) parking spaces in addition 24 to those required for dwelling, provided such 25 parking spaces shall not be located in any re- 26 quired yard or open space. 27 2.2 MINIMUM LOT AREA: 28 Mini mum Iot area required of a lot per dwelling unit shall 2g be not less than eight thousand, one hundred twenty-five (8,125) 30 square feet. 31 2.3 MINIMUM LOT G~IDTH: 32 Mini mum lot width shall be not less than sixty-five (65) feet. -2- 1 2.4 MINIMUM FRONT YARD: 2' Minimum front yard shall be fifty (50) feet from the 3 centerline of the road, except where the road is classified by 4-the County as a Federal Aid Secondary Road, the minimum building 5 setback reguired shall be fifty-five {55) feet from the centerline 6 of said road. 7 2.5 MINIMUM SIDE YARD: g Minimum side yards shall not be less than five {5) feet. g SECTION 3. All uses of land within the district not 10 specifically authorized and permitted in Section 2 are prohibited. 11 SECTION 4. In compliance with the provisions of said 12 Zoning Enabling Ordinance, the same is hereby amended by adding 13 this Ordinance in full. 14 SECTION 5. The penalties for the violation of the zoning 15 hereby imposed within the district shall be as provided in the 16 Zoning Enabling Ordinance. In compliance with the provisions of 17 the Zoning Enabling Ordinance, this Ordinance shall from and after lg its effective date become a supplement to and part of the Zoning 19 Enabling Ordinance. 20 SECTION 6. This Or@inance shall be and it is hereby de- 21 clared to be in full force and effect from and after thirty {30) 22 days after the date of its passagep and before the expiration of 23 fifteen (15) days after the date of its passage this Ordinance 24 shall be published once with the names of the members of the Board 2B of Supervisors 'noting for and against it in the CHTCO ENTERPRISE 26 RECORD a newspaper published in the County of 27 BUtte, State of California. 2g PASSED AND ADOPTED by .the Board of Supervisors of the 29 County of Butte, State of California an the 25th day of 30 August 1970, by the following vote: 31: AYES: Supervisors Howsden, Maxon, McKillop, Reynolds and Chairman Dunaway 82 NOES : None -- 3- ~l 2~ 3 ~. 5 6 7 8 9' TO 11 12. ].3 14 15 16 17 18 19 20 21 22. 23. 24 25 26 27; 28 29 30 31 32 ABSENT: None 0.
