HomeMy WebLinkAbout1109ORDINANCE N0: 1109 AN ORDINANCE 20NING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AN "RT-1" (MINIMUM-DENSITY RESIDENTIAL TRAILER) DISTRICT, PURSUANT TO ORDINANCE 475, OF SAID COUNTY AS AMENDER 1 2 The Board of Supervisors of the County of Butte, State of 3 California, under and pursuant to Ordinance No. 475 of said County, 4 .being the Zoning Enabling Ordinance, as amended, DOES ORDAIN as 5 follows: 6 SECTION 1. The hereinbelow described area, situate in the 7 County of Butte, State of California, shall be and it is hereby 8 zoned an "RT-1" (Minimum-Density Residential-Trailer) District, and 9 such area shall be subject to the restrictions and restricted uses 10 and regulations hereinafter specified and provided, said area being 11 located in the unincorporated area of Butte County near Oroville, 12 California, and particularly described as follows: 13 All that part of the Northeast quarter of the Northeast quarter of Section 15, TIN R4E, MDB&M, located east of 14 "Glenn Drive", containing 9.14 acres m/l. 15 SECTION 2, The following regulations shall apply in an 16 "RT-1" ;(Minimum-Density Residential-Trailer) District: 17 2,1 USES PERMITTED: 18 a. Single-Family dwellings. 19 b. Mobile Homes to house one family, when such Mobile 20 Home is the only housing facility located on the 21 premises, provided the following conditions are con- 22 formed to: 23 1. The floor area within the Mobile Home shall not 24 be less than 500 square feet. 2~' 2. All sanitary facilities shall conform to State 26 Statutes and regulations and to local requirements 27 of the Health Department; and 28 3. All electrical installations shall conform to 29 State Statutes and regulations. 30 c. Accessory buildings pertinent to the permitted uses. 31 d. Household pets, but not including livestock, poultry 32 or poisonous reptiles. 1 2.2 LOT AREA REQUIRED: 2 Minimum lot area of a lot per dwelling unit or a Mobile 3 Home unit shall be no Less than eight thousand, one hundred and 4 twenty-five (8,125) square feet excepting where public sewage 5 disposal service is provided, a minimum of six thousand, five 6 hundred (6,50D) square feet may be allocaed for inside lots with a 7 minimum of seven thousand, five hundred (7,500) square feet for 8 corner lots. 9 2.3 LOT WIDTH REQUIRED: 10 A4inimum lot width shall not be less than sixty-five (65) lI feet. 12' 2.4 FRONT YARD REQUIRED: 13 Minimum front yard shall be fifty (50) feet from the center 14 line of the road, except where the road is classified by the County 15 as a Federal Aid Secondary Road the minimum building setback re- 16 quirement shall be fifty-five (55) feet from centerline of said 17 road. 18 2.5 SIDE YARD REQUIREMENT: 19 Minimum side yard shall not be less than five (5) feet. $0 2.6 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMIT 2], IN EACH CASE 22 a. Golf courses and country clubs. 23 b. Public and quasi-public uses including churches, fire 24 houses, hospitals, parks and playgrounds, schools and 2g public utility buildings. 26 SECTION 3. All uses of land within the District not 27 specifically authorized and permitted in Section 2, are prohibited. 28 SECTION 4. In compliance witkz the provisions of said 29 Enabling Ordinance, the same is hereby amended by adding to Section 30 5 thereof this Ordinance in full. 31 SECTION 5. The penalties for the violation of the zoning 32 hereby imposed within the district shall be as provided in the . -2- 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 28 26 27 28 29 30 31 32 Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 6. This Ordinance shall be and it is hereby de- clared to be in full force and effect from and after thirty (30) days after the date of its passage; and before the expiration of fifteen {15) days after the date of its passage this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the PARADISE POST a newspaper published in the County of Butte, State of California. PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California on the 25th day of August 1970, by the following vote: A7.'ES: Supervisors Howsden, Maxon, McKillop, Reynolds and Chairman Dunaway NOES : None ABSENT: Norte 0.
