RESOLUTION CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, 5AFETY, OR
WELFARE REQUIRE THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON MYER5 STREET FROM WYANDOTTE
AVENUE TO LINCOLN IBOULEVARD
(PG&E PROJECT -MYERS ST. BUTTE COUNTY R20A)
WHEREAS, Chapter 26A of the Butte County Code establishes a procedure for the creation of underground
utility districts and requires as the initial step in such procedures the holding of a public hearing to ascertain whether
public necessity, health, safety, and welfare require the removal of poles, overhead wires and facilities for supplying
electric, communications, orsimilar orassociated services in any such district; and
WHEREAS, it has been recommended that such an underground utility district, hereafter called Butte County
Underground District 30C tPG&E Project -Myers St. Butte County R20A,) be formed on Myers Street from Wyandotte
Avenue to Lincoln Boulevard,
NOW, THEREFORE, SE IT RESOLVED A5 FOLLOWS:
Notice is hereby given that a public hearing will be held by the Board of Supervisors of the County of
Butte on November 22, 2011, at the hour of 10:00 AM in the Board of Supervisors Chambers of the
Administrative Building, Oroville, California to ascertain whether public necessity, health, safety or
welfare require the removal of pales, overhead wires and facilities for supplying electric,
communications, or similar or associated services in the District described above.
2. At such hearing, al! persons interested shall be given an opportunity to be heard. Said hearing may
be continued from time to time as may be determined by the Board of Supervisors
3. The Clerk of the Board shall notify al[ affected property owners as shown on the last equalized
assessment roll and utilities concerned of the tune and place of such hearing by mailing a copy of this
resolution to such property owners and utilities concerned at least ten (10) days prior to the date.
4. The area proposed to be included in the District is shown upon that certain map entitled BUTTE
COUNTY UNDERGROUND UTILITY DISTRICT N0.30C MYER5 ST. FROM WYANDOTTE AVE. TO LINCOLN
BLVD. (PG&E PROJECT -MYERS ST. BUTTE COUNTY R20A,) dated September 13, 2011, which is on file
in the offices of the Clerk of the Board and Director of Public Works of the County of Butte.
