SUBMITTED TO THE VOTERS AT THE JUNE 5, 2012 ELECTION
WHEREAS, the Butte County Board of Supervisors has adopted Ordinance Number 4029,
adding Chapter 34A of the Butte County Code regulating the cultivation of medical marijuana in
the unincorporated portions of Butte County; and
WHEREAS, said Medical Marijuana Cultivation Ordinance was challenged on June 22,
2011 by a petition protesting it pursuant to Elections Code Section 9144; and
WHEREAS, the Butte County Clerk-fiecorder/Registrar of Voters certified on July 27,
2011 that the petition had been found sufficient; and
WHEREAS, on August 9, 2011, the Board approved submitting said Medics! Marijuana
Cultivation Ordinance to the Woters of the County at the next regularly scheduled county
election.
NOW, THEREFORE, BE IT RESOLVEI], by the Board of Supervisors of the County of Butte,
State of California, as follows:
1. The Board hereby submits the Medical Marijuana Cultivation Ordinance to the voters at
the next regularly scheduled county election on June 5, 2012;
2. The question to be submitted to the County voters at said election shall be: Shall the
Medical Marijuana Cultivation Ordinance, Ordinance Number 4029, be adopted?
3. Said election shall be consolidated with the statewide primary election to beheld on
June 5, 2012;
4. Said election shall be held and conducted pursuant to the procedures specified in Part 3
of Division 10 of the Elections Code commencing at Section 10400;
5. Far purposes of this election, and Ordinance Number 4029, the "County voters" and the
"County electorate" shall include all voters in the County, including voters in the
incorporated areas of the County; and
6. In accordance with Elections Code Section 13120, the question to be submitted to the
voters shall read as follows:
MEDICAL MARIJUANA CULTIVATION ORDINANCE REFERENDUM
Shall-the Medical Marijuana Cultivation Ordinance, Ordinance Number 4029, be adopted?
YES [ ]
NO [ ]
PASSED AND ADAPTED at a regular meeting of the Board of Supervisors of the County
of Butte, State of California, on the 22"d day of November, 2011, by the following votes:
AYES; Supervisors Connelly, Wahl, Kirk, Yamaguchi and Chair Lambert

ABSENT: None
